|Transcription=That hee this deponent being Master of and in the shipp the ''Peregrine'' in
Company and consortshipp with the shipp the ''dragon'', being both men of warr
and in the imediate service of the Parliament of England, and lying in the Bay
of Galloway, espied a shipp comeing from thence, being the Enemies quarters
did make after her with the said shipp the ''dragon'', and did make the first shott att
the said shipp, and in [XX] and the Company thereof defected the said
shipp and went on shore, Imediately after which hee saith that the Company of the
''dragon'' did first board the said shipp, and then the Company belonging to the
''Peregrine'' went also aboard the said shipp, and did then and there
take her as prize and had equall plunder and share of the pillage of the shipp,
And hee saith that by the bills of ladinge and other writings which they found abord
the said shipp she was called by the name of the ''ffortune'', and belonged to [XXXXX]
or some Port in Zeland,. Which seizure as aforesaid was made in or about the
monthes of July or August 1650 and the said shipp was carryed by the ''dragon'' aforesaid into some of
the Parliaments quarters in Ireland where she was condemned and sould for prize, And
this deponent saith that afterwards hee this deponent as Master of the ''Peregrine''. and the rest
of the Company thereof had theire share of the said prize duly paid or allowed
them, And further hee saith hee cannot depose./

Mariner aged 41 yeares or thereabouts, master
of the said shipp the ''houlter Church'', being
of the sort there called Monists and here Anabaptists, and
therefore refusing to lay his hand upon the Evangelists,
undertooke and promised before the right Worshippfull William
Clerke doctor of lawes one of the Judges of the high Court of
the Admiraltie to speake the truth upon his examination on
the Interrogatories given in this busines in the name and as in the
presence if Almightie God, and then being examined upon
the said Interrogatories, saith and deposeth as followeth, [XXXXXX].

To the first Interrogatorie hee saith and deposeth that the said shipp the
''houlter Church'' or ''B[XXXX] houter kirke'' belongeth to the port of Serdam in holland, and that
hee this deponent, John Johnson ?Roge, John ffrederickson, Claus
Cornelison, William Claeson and others of Serdam and two or three of
Edam and one Peterson master of Amsterdam being in number 43 persons
and all dutch men and subiects of the States of the United Netherland
pr[XXXXXXX] and not one of them ffrench were and are the true and lawfull
owners and proprietors of the said shipp the ''houter Church'' and of her
tackle apparell and furniture, and soe commonly accompted, and were
and are all very well knowne unto him this deponent, master of the
said vessell

vessell was a ?Rosse in ffrance freighted by Charterpartie by a
ffrenchman whose name hee remembreth not, which Charter partie with
his seabrief and all his letters and papers were taken from him by

the gate of the dwelling house of the said Ashley in [?Hackney XXk], there being present his said
precontest, And otherwise hee referring himself to his for[?said] depositions he saith
he cannot depose

saw the said Captaine Ashley before such time as hee went with the
producent, to his house, as before he hath deposed And saith that hee wisheth
the victory in this cause to him that hath most right, And otherwise negatively

To the second hee answareth negatively, and otherwise then as hee hath
deposed hee saith he knoweth not./

To the third hee answarth negatively./

To the 4th hee saith hee was present when the said Captaine Ashley
did confesse that hee did take the producents shipp and when hee made a [?promise]
to meete him about the same, which was about 4 monthes since, before the
doore of the house of the said Ashley, there being also present att the same
time his contest Thomas White, All which was spoaken promised, and uttered
in the words which hee hath deposed to which hee referreth himself and further
hee cannot depose./

the saving of the shipp the ''ffortune'' deposeth as followeth. That hee
this deponent was one of the Company of the Shipp the ''Peragrine'', and
in Company of the shipp the ''Dragon'' (both belonging to the Parliaments
ffleete, and Men of Warr) when the said shipp the ''ffortune'' was taken surprized
and seised, as she came out of Galloway in Ireland from the [XXXXXs] quarter
And saith that att the time of the sisure thereof videlicet in or about the month of
July 1650, the said Shipp the ''Peregrine'' (whereof John Wood was Master0
did make the first shott att the ''ffortune'', and was imediately in
[?with] the said shipp the ''dragon'' and saith that hee this
deponent and divers of the said shipps company was almost as soone abord
the shipp the ''ffortune'' as those of the Company belonging to the ''dragon'' and
