such wilfull default in delivery and
imbeazelment ot the dammage of this
rendent as aforesaid
yet did make an undue demand as
hee beleeveth of and from this Rendent
of such freight as should have bin due
to him by the said charter party incase
hee had made good delivery and noe
imbeazelment att all which this respondent
conceiving to bee uniust and expecting
upon iust grounds to receive satisfaction
from the said Peeterson for his said dam=
madges sustained by the reasons aforesaid
did upon good cause as hee beleeveth
refuse to doe and this Rendent alsoe
beleeves that the said Peterson did upon
the third of ffebruary 1650 make a
protest against this rendent and the said
Alexander barron before Josua Maniet
notary publicke of the Tenor of the sch
dule hereunto annexed and that this
respondent conceiving himselfe soe
iniured and wronged by the said protest
did upon iust cause as hee beleeveth
procure this Courte to bee involved
to grant summons against the said
Peeterson to appeare in this Courte to
the intents and purposes in the decrees
and summons in this Courte expressed
And this Rendent doeth further beleeve
that the said Peeterson was duely served
there with and that hee appeareing there
unto and a copy of the said protest and
alsoe a copye of the said charter party
being exhibited into this Court and
acknowledged by the said Peeterson and
the matter of the said protest being
