Transcription

Ad tertium arlum deponit that in the said time allegate and in persuance of
the said voyage the said Giles Van Zype and Company did fet and
orocure from the Admiraltie of the Kinge of Spaine at Bruges
and from the Judge of the said Court, authorized by the said Kinge for such affaires,
a Commission or letters of marque or Reprizall for the
sursprizing and taking of any of the shipps and goods belonging to the King
of ffrance or any of his subiects, reddens raconem scientia sua ut infra, alr necit.

Ad quartum arlum et ad schedulam primam annex ei [?ostenXXX] dicit et deponit
that the said schedule was and is the Commission or letters of marque or
reprizall [?promoted] unto the said Giles Van Zuype and company, the
stters forth of the said shipp, which hee knoweth because hee this deponent
being rgereto imployed by the said Giles Van Zuype received the said letters
of marque or Commission from the hands of myn heer Clawsone
President of the said Court of Admiraltie, at Bruges on or about
the daye of the date of the said Commission being the 18th of Januart
newe style, Et alr nescit referando se ad contenta dicta Commissionis
et [?TrXXXX] [?laconis] des[?urper] [?facta]./

Ad quintum arlum deponit that the said Giles Van Zuype and company
within the said time allegate did constitute and appoint him this
deponent Commander and Captaine of the said shipp, and further
hee this deponent was and is authorized and appointed to goe Captraine
and Commander of her by the said letters of marque and Reprizall
for the said warlike voyage, and accordingly hee this deponent went
Captaine and Commannnder of the said shipp the said voyage, and
as and for Captaine and Commannder of her hee was and is
commonly accompted reputed and taken, alr nescit.

Ad sexum arlum deponit that by vertue of the said Commission or letters
of marque or Reprizall, this deponent and company n board the said shipp the Saint Giles did on the
21th day of January last past olde style seize take and surprize
the ffrench vessell arlate whereof William Cornoville was master
together with her lading of herrings in her course from Diepe to Saint
Mallo's, Et alr nescit.

Ad septium arlum deponit that after the taking and surprizing of the
said ffrench vessell, hee this deponent and company intending to carry
the said prize to Ostend, and there to have procured the same to be
adiudged as lawfull prize, were by contrary windes and extremitie
of weather and for preservation of their said prize inforced to put
and did putt and come with the said shipp Saint Giles and the said prize
into the harbour of Portsmouth where the said prize nowe remaineth.

Ad ocavium arlum deponit that the second schedule arlate (shewed unto him
alsoe at his examination) was found and taken onboard the said ffrench
vessell, this deponent taking the same with his owne hands out of
the Packet of the said William Corneveille on board her, which [?XXX] [?for] [?XXXX], [?whoe] was killed in fight when
the said shipp was seized, Et alr nescit, saving the contents of
the said schedule were and are true.

Ad ulto dicit predepoita per [?XXXX] vera.

Ad Interrogatoria. [CENTRE HEADING]

Ad primum rendet that hee this rendent was Captaine and Commannder of
the shipp the Saint Giles at the time interrogate, and saith it was on a
sunday that the said ffrench shipp was soe taken by the Saint Giles, and the
said ffrench shipp had bin about thirtie houres taken before shee was
soe brought into Portsmouth, and was taken upon the ffrench coast betwixt
[?Strusart] and the [?Sene] head, which place hee saith is about twice soe
farr from Ostend as it is from Portsmouth, being about 48 leagues
from Ostend and as hee conceiveth not abouve 24 or 25 leagues from
Portsmouth, and saith Portsmouth was out of the way from the said [?place]
[?where]
