2nd October 1651.

Alderman dethwick against Bushell.}

Examined upon the Libell.

Smith dt.

1us.

Captaine Edward Wye of Ratcliffe in the County of Middlesex Mariner
aged 43 or therabouts sworne and examined.

To the first article of the said libell hee saith and deposeth
that in the monethes of Aprill and May 1650 the arlate John Bushell
had and received in Lisbone of and from this deponent for the
use and accompt of the producent Alderman John dethick the somme of
eightie three Mill Res and Nine hundred Res Portugall money
and alsoe three hundred ninetie eight Mill Res and eight hundred and tenn Res
Portugall money, and gave this deponent his receipt for the same
under his hand, which money hee the said John Bushell promised
and undertooke to him this deponent to pay and satisfie unto the said
Alderman dethick, and since the said receipt the said John Bushell
hath at severall times and places in Lisbone spoken of the said receipt
of the said moneys in this deponents presence and hearing and acknolwdged
the receipt thereof, and againe repeated his promise to this deponent
of satisfyinge the said Alderman dethick therefore, being as hee
said received by Alderman dethicks order given unto him and
to his the said Aldermans use. And otherwise hee cannot depose.

To the second hee saith that hee cannot depose, but beleeveth and hath
heard that the said money is still unpaid and unsatisfied to the said
Alderman dethick, who in not receiving thereof must needs have
bin much damnified in respect both of principall and interest.
And otherwise hee cannot depose.

To the third article hee saith and deposeth that every Mill Re of the
said Portugall money was the time aforesaid and is there worth the
summe of twelve shillings and six pence sterlinge
and that 1000 Res make a Mill Re, which hee knoweth having
longe frequented the said port of Lisbone and being thereby well
acquainted with the valewe and condition of that money. And otherwise
hee cannot depose saving the said money was then worth about 20
in the hundred lesse there than at Lisbone,

To the first hee saith that if hee had not delivered the said money
to Mr Bushell hee this examinate were debtor therefore to the said
Alderman dethick, but hee having as hee saith paid the same to the said
Mr Bushell according to Alderman dethicks order, hee is not nor
ought to be liable for the same though the said Alderman be un satisfied
from Mr Bushell.

To the second hee saith that the said Mr Bushell received the said moneys
of him this deponent as having order therefore from the said Alderman
dethick, signified unto him this examinate by the said
Alderman by letter, and then the said Mr Bushells estate was [XXX]
seized by the kinge of Portugall or his officers, but about three monethes
after his estate was seized by the said kinge or his ministers.
