Transcription

To the 24th hee saith that the said narratons and Peeces of ight
were laden on board the said ship within the Command of the fforts
at cadiz And otherwise cannot depose.

To the 25th hee referreth himselfe to his foregoing deposition And further
cannot depose.

To the 26 and 27th hee saith that hee for his part doeth not knowe the lawes
of Spaine touching et cetera. And soe as hee hath answered to these interrogatories in his
foregoeing answers.

Let this be extended.

Examined upon the said Allegation,

John de Vos of Ostend Commander of the Ship Saint John
Evangelist' aged 47 yeares or thereabouts sworne and
Examined deposeth.

To the first second and third articles of the said Allegation hee saith
and deposeth That in or about the moneth of Aprill last past there was
att Cadiz laden on board the Shipp Saint John Evangelist whereof this deponent
was then Commander for the accompt of the said Robert Scorion
one bag therein conteyning three hundred peeces of eight Mexico and

Sevill marked with the marke un the margent. to bee transported in the said
ship from Cadiz to Ostend or Dunquirke where the same was to bee
delivered to the said Robert Scorion or his assignes for his propeer
riscoe and accompt; hee the said Robert Scorion being commonly accompted
the true and only Owner thereof. All which hee knoweth because hee was
at the ladeing of the said peeces of eight one board the said ship Comander
thereof and sawe the same laden thereupon and then signed bills of ladeing
for the same as laden by one Juan Calmesa Spanish factor [?resident] at Cadiz)
for the propper account and Riscoe of the said Robert Scorion. And further
cannot depose.

To the 4. 5. and 6th articles of the said Allegation and to the schedule or bill of
ladeing annexed and now shewed unto him hee saith and deposeth, That
upon the ladeing of the said three hundred peeces of eight on board the said ship under
the marke and number predeposed hee this deponent did signe and
subscribe, three bills of ladeing (and noe more) all of one Tenor and dated
for the same one of which said bills the said factor by whom the said peeces
of eight were laden delivered to this deponent to bring along with him in the
said ship and the other two hee tooke with the said moneys on board
her towards Ostend or Dunquirke and in her passage thitherwards was
mett with surprized and taken by Captaine Cox in the Phoenix frigot
in the ymediate service of this Commonwaelth att which tyme the
said 300 peeces of eight under the marke and number aforesaid were on bord
her tpgethere with one of the said bills of ladeing signed by this deponent
for the same both which came to the hands of the said taker thereof And
