Transcription

well knoweth being a Newcastle man and having severall Voiages sailed
and served in and aboard the said shipp as aforesaid, and thereby having
very goods knowledge of and acquaintance with the sid Master and Owners
as is predeposed And further cannot depose/:-

To the second hee saith, That in the yeare 1652. arlate, the said shipp
the Charity being at Wexford in Ireland was there by the said Master
in the name of himself and of his said fellow Owners lett to freight
to the arlate ffrancis harvey a Merchant of Wexford, to goe
with a lading of herrings from thence to Bourdeaux, but in their
Course thitherwards were by contrary wind constrained to putt into
Waterford in Ireland, whence by thesaid Merchants ffactors direction
they went in Companie with five saile of English shipps bopund with
[?Toreis] for Saint Sebastians in Spaine, and about 2. moneths after their
arrivall there, by the said factors direction, shee sett saile from thence
for Bourdeaux, and in her Course thitherwards was taken by
a hollands Merchant shipp bound for Bayon in ffrance, and was
there brought up, and the said harrigate and company were
turned out and dispossessed of the same, and saith That the Master
or Commander of the said Merchants shipp being examined before the
Governor of Bayon, did, as this deponent then and there credibly heard
from the said factors and from the Master of the said Vessell the Charity
declare, that hee had no Commission or authority for the seizure of the
said shipp the Charity and her lading, The premisses hee deposeth, for that
hee served in and aboard the said shipp all the Voiages aforesaid as
Boateswaine thereof, and was brought in her to Bayon upon the
seizure aforesaid. And further cannot depose/:-

To the 3. hee saith, hee hath not seene the shipp Charity allate since
hee left her aty Bayon after her said seizure, and therefore cannot
depose anything as to the identity of the said shipp, and the shipp now
in Controversie/

To the 4th hee referreth himselfe to the acts of this Court. And further
cannot depose./

To the 5th hee saith his foregoeing deposition is true:-/
