Transcription

to procure an English shipp to touch at the said Island, and to deamnd the
said Oyles of the Governor thereof, which was accordingly done, but
the said Governor absolutely refused to deliver the same, saying they
were by his order used and employed to and for the service of the
sayd Island, or to that or the like effect, as this deponent hath seene and
observed by credible letters of advise since received from those parts [?and GUTTER]
by a Certificate from the said Island to that purpose./

To the 5th hee saith, hee beleeveth, That the sayd Oyles in case they
had not been so detained as aforesaid, but had safely come to and arrived
in England would have amounted here to the full summe or value of
one Thousand pounds sterling or thereabouts; but how much the said
Owners are otherwise damnified by the detention and losse of the sane hee
saith hee cannot particularlize. And further cannot depose

To the 6th hee saith the arlate Edward Noseworthy Peter [?kXXX GUTTER]
and John hallett for all the time predeposed were and still are
commonly and generally accompted reputed and taken./

To the last hee saith his foregoeing deposition is true./

Elizeus Spillebaut of Buttolphs
Lane neare Billingsgate London Boake-keeper to the said
Arnold Beake aged 34. yeares or thereabouts a
Wittnesse sworne and examined saith as followeth

To the first article of the said Allegation hee saith and deposeth, That
in the moneth of January 1653. arlate, being severall moneths before
the Peace was concluded upon between this Commonwealth and the [?XXX GUTTER]
of the United Netherlands Provinces the shipp the Saint John Baptist
arlate (John Claesson Master) was by Mr Arnold Beake, Elias
Beake and Companie sett out from dover upon the Voiage in Controversy
for Bayon in ffrance, with a Cargaizon of goods for their accompt Which
hee this deponent well knoweth, for that hee was before and at that
time and till this present Booke-keeper to the said Arnold Beake
and thereby hath particular knowledge of his merchandizing affaires
and amongst the rest of the employment of the said shipp Saint John Baptist
And saith that at that time the danger of suprizall of English
shipps and goods by the dutch was publique and notorious./

To the second article and schedule therein hee saith and deposeth, That the said Arnold
and Elias Beake well knowinge the then imminent danger of the
