Transcription

make accompt to and pay the sayd Tayler an eighth part of the freight and profitt
due and earned by the sayd vessell the sayd voyage, and alsoe for that this deponent
knoweth and hath seen the sayd Wise accompte and pay to the sayd Tayler an eighth part
of the freight and profits made by him the sayd Wise for other voyages which
hee made as Master of her and hath heard alsoe many tymes [?XXX XXXX] that the sayd Tayler was owner of an eighth part of the sayd [?vessell] And further hee cannot depose saving hee
saith that after the sayd Wise had continued master of the sayd vessell the Blessing
divers yeares hee sold (as this deponent hath heard) his interest in her and thereupon
the arlate George Blake became master of her, and is commonly accompted to
bee Owner of her./

On the behalfe of Captaine}

Rp.

Thomas de la vall of dover Merchant, aged 35 yeares
or thereabouts sworne before the right worshipfull
Charles George Cock Esquire, one of the Judges if the
high Court of the Admiraltie, saith and deposeth as
followeth, videlicet.

That about tenn monthes since their issued out of this high Court
a warrant at the sute of John Phillips against one Thomas
hart of Dover for the arresting of the said Thomas hart, which was
delivered to [BLANK IN MANUSCRIPT] Simpson Sergeant of the Admiraltie there to be
executed; but the said Simpson in regard doctor Walker his hand was
not set thereto, refused to execute it. Whereupon there was afterwards
namely about three monethes since anthor warrant obtained from
this Court at the sute and to the effect aforesaid, on the back whereof
doctor Walker gave libertie for the exection thereof and set his hand
therto, And the same was alsoe delivered to the said Simpson to bee
executed, but the said Simpson keepeth the same in his
hand and hath soe donne for theise two monethes last or
thereabouts, and refuseth to execute and doth not execute
the same although hee hath bin by this deponent and others [?XXX]
thereunto, and although the said hart walketh frequently
and publiquely abroad in dover, where the said Simpson [?XXX]
many times have executed the said warrant, if hee would
soe have donne.
