Transcription

1. wheate and taken in her homeward lading of pitch, prunes, vinegar
2. strong waters and other goods for the account of the said producents,
3. and departing from Bourdeaux therewith for Southampton, ˹the said shipp˺ was off
4. Groy on the coast of Bretagne met with by a Brest man of
5. warr on a day happening in or about the moneth of June 1655
6. which Brest man of warr having but foure guns, came came up
7. with which set upon and shott at the said shipp the Prosporous, whose
8. master and company betook them selves to their defence, and retourned
9. shott at the said Brest man, and soe they continewed fight about
10. an houres space, and untill the small quantitie of ˹shot and˺ powder that
11. was in the Prosporous was spent, and shee not being able to make
12. further resistanse shee was forced to yeeld, and was taken by the
13. said man of warr and all her said lading, and lost, wheareas had
14. shee had sufficiencie of shot and powder shee might haue evaded
15. for hee saith the Constant Warwick (one of the shipps of warr
16. of this Commonwealth) seeing the said fight was standing with
17. all the speed she could make towards them, and was come within
18. a league and halfe of them, when the Prosporous her shott and
19. powder failed, and soe shee and her lading became a prey to the
20. enemie, who presently carried them away into the next ffrench
21. harbour, the Constant warwick chasing them, South at hee
22. (through the want of sufficiencie of shott and powder) hee hee XXXX XXX
23. the said vessell the Prosporous to be lost with her lading. all which hee
24. knoweth, being pilot of the Prosperous, and present at the premisses.

25. To the 8th hee cannot depose,

28. To the first hee saith the said producents required him to come and
29. speake the truth in this cause, and have promised to beare his charges
30. and saith hee hath not discoursed with any about what hee should
31. therein dipo depose, and otherwise cannot negatively saving as aforesaid

32. To the second ˹and third˺ hee saith the said vessell carried noe more than two
33. peeces of ordnance and seaven muskets, and saith there were noe
34. more or other shott or powder there as aforesaid, which hee knoweth
35. taking notice of ˹and (as hee beleeueth) being˺ all that came or was put aboard, and of all that
36. could be found in the said fight, And with the said man of warr
37. had by their owne reckoning 36 men and boyes, XXX all or most part
38. whereof appeared on the decke; And saith there was a vessell of
39. Yarmouth in the Prosperous her company when the Brest man of
40. warr chased them, and when the said man of warr approached the
41. said vessell (whereof one Applebie was master) fledd and bad
42. them of the Prosporous shift for for them selves, And otherwise hee
43. cannot answer saving as aforesaid.

44. To the third ˹fourth˺ negatively.

45. To the 5th hee saith the said man of warrs company did not enter when GUTTER
46. offered to enter the Prosperous till all her shott and powder were spent
47. in the fight, and that her master and company yeelded and called for GUTTER
48. quarter, only hee with there was one gun laden and undischardged
49. when the Prosperous yeelded, it being as hee saith the manner of GUTTER
50. shipps at sea that are in yeelding condition to keepe one gun
51. loaded, for defense during parley and calling for quarter, and otherwise
52. hee referreth him selfe to his foregoing deposition

53. To the last hee saith that it is true the winde was contrary to the
