to whom they declared as hee done there before and saith that the said
seizure was made on the 10th August last new stile, and hee had then
only the Spanish Colours onboard, and shee never carryed any other since and
was master of her, and sayth that the said vessell hath no decke being but a small
ffishing vessell, et alr nescit salvis predepoita, saving hee saith that before hee was made
master of the said ship, the foresaid owners of her sent her out as hee was informed upon their
accounts two Voyages to fish and some of his now company then served in her

Ad primum rendet That hee hath knowne the said ship Orange Tree
Detliff Hendricksson master for about Eight yeeres last past namely from her building and
sailed in her ever since the latter end of last winter, and saith that during
all the time that hee hath knowne her shee hath belonged to ffrederickstadt
which is under the Earle of Holsteyne and there shee was built and this deponent there
sawe her building, and saith that John Derickson John ffolkeand the
skipper were and (are) her owners and soe have bin ever since the said ship was built
and saith that they all did and doe live in ffrederickstadt aforesaid where they were borne
and are free Burgers there, and saith that hee knoweth that the said Owners gave

burthen and when shee was taken shee was Laden with Clapboards and
crooked [?oake] wood to build ships with and some geathers, which was laden on board
the said ship at ffederickstadt aforesaid but by whose or for whose account hee
knoweth not, which lading was consigned to Holland sent for what place
there hee knoweth not, and saith that this deponent was hired at ffrederickstadt to goe to Holland
the said voyage by the said skipper who had noe other but this deponent onboard
and saith that this deponent and the said skipper were both borne at ffrederickstadt
and there allwaies lived, And saith that what writings there were onboard
at the said ships seizure came to the hands of the said Mr [?XXX] none were
burnt torne throwne overboard or otherwise made away that hee
knoweth of and saith that the seizure was made about ten dayes
since by the Crowne ffrigott, and then the skipper and this deponent
declared that they were of ffrederickstadt, and that they were bound to
Holland, and saith that before this voyage was begun this deponent made
two voyages wuth in the said shipp in ballast from ffrexderickstadt to Norway
and brought back deales to ffrederickstadt for the account of merchants of
ffrederickstadt, but who hee knoweth not, And saith that the said shipp
carryes the ffrederickstadt flagg (being a Nettle leafe) and shee never carryed
