continued the certificate in the same state that now it is untill munday next in
the afternoone./.

Which day the said Colequite upon the libell by him in this
cause given and admitted produced for a witnes Thomas
davalla whom the Judges reeaved and administred an oath unto
him to speake the truth at the time of his examination in the presence
of Suckley dissenting and having the usuall time for Interrogatories./.

Curtes against Cockaine}
Clements Smith}

Which day appeared Bartholomew holway and left in the
Registry of this Court nine pounds tenne shillings formerly
ordered by this Court to be brought in by Mr Cockaine for the
wages of Michael Clemincke mentioned in the proceedings of this cause./.

Powell and others late master and marriners}
of the shipp the hopewell against Valentine}
Austin Robert Lewellin and Peter Mackrel}
Suckley Clements}

Which day appeared the said Clements on the
behalfe of the said Valentine Austin and
alleadged that notwithstanding he is owner
only of an 8th parte of the said shippe and noe more yet he
is taken in execution from this Court for the
wages adjudged by this Court to be paid to the
marriners of the said shipp for their service for the
voyage controverted in this cause and kept and
detained in prison for the same The Judges beinge
satisfied that the said Austin is owner only of one 8th parte
of the said shippe and being then informed that he hath tendred
the summe of 43 li 1 s 10 d being the one full 8th parte of the
wages adjudged to all the said marriners of the said shipp (except
the said Powell) and for that it likewise appeared that the said
Lewellin is owner of one 4th parte of the said shippe and the said
Mackrel of another 4th parte and the said Powell of one 8th parte and
Jauncy of one 4th parte and that the said Powell and Llewellin then
put in Courte and Mr Clements on the behalfe of the said Mackerel
undertooke to pay into the hands of the Marshall of this Court their
respective proportions of the wages due to all the said marriners of the said
shipp except the said Powell according to their proportionable parte of
the said shipp whereof they are owners The Judges upon consideration
of the premisses did decree the ex[?ecution] against the said Valentine Austin
for the wages of all the said marriners except the said Powell to be
superseded in case it shall appeare unto the Marshall that hee
hath deposited in his hands his Eighth part of the said marriners
wages and the said Lewellin payinge into the hands of the Marshall
one quarter parte of the said marriners wages exceptinge the said
Powells wages and the said Mackrel payinge his 4th parte
thereof as aforesaid The Judges did decree them to be released
and discharged from the said execution and they likewise ordered
the said Powell to pay his 8th parte of the said Wages
into the hands of the Marshall and the said Wages beinge
by him receaved to be by him paid unto the respective persons
mentioned in the schedule annexed to the said [?exXXXX] to
such persons as he shalbe satisfied have right to receave the same and at
Suckleys petition the Judges did decree the said Jauncey
to be monished tp appeare imediate et cetera to shew cause why he
should not pay his proportionable part of the said wages./.
