went from Cowes in the Ile of wight and arrived safely at London<br />

Loathbury London Cittizen and draper of London aged<br />
30 yeares or thereabouts a witnesse sworne and Examined<br />
deposeth.
To the first second third and fowrth articles of the said Allegation hee<br />
saith hee cannot of his owne certaine knowledge depose any thing<br />
thereunto./
To the 5th 6th and 7th articles of the said Allegation That upon his<br />
this deponents comeing to Portsmouth upon or about the tyme of the sincking and<br />
damnifying of the Tobaccoes now in question hee was there by severall<br />
credible and understanding persons informed That the shippe the<br />
''Mayflower'' arlate in and upon which the said Tobaccoes were and had bin<br />
laden, at such tyme as the same was soe laden thereupon (haveing but<br />
a very short tyme before bin well mended and repaired in all particulars)<br />
was a very firme and a tight ship and very able and fitt to carry and<br />
transport Merchants goods, And that the night in which shee was sunke<br />
was soe stormy and Tempestuous as that severall other shipps then in<br />
the Harbour of Portsmouth were broke and forced from theire Anchors and Cables<br />
by violence thereof. And otherwise saveing his foregoeing deposition<br />
hee saith hee cannot depose./
To the 8th article of the said Allegation hee saith and deposeth that ymediately up<br />
pon such the putting of the said Tobaccoes on bord the said Ship<br />
the ''Mayflower'' the producents and Company did send Expresse<br />
Orders and directions in writeing unto John Bayly the master of<br />
the said vessell to come away with the same from Portsmouth<br />
to London with the first cnvenient winde and weather, which ordders hee the<br />
said Bayle upon the hapning of the disaster of the sincking of<br />
the said Shippe and Tobaccoes did att Portsmouth in the hearing<br />
of this deponent and others declare hee had received And that<br />
hee was ready accordingly to have come away therewith long before<br />
the said disaster hapned if the said ship and goods had not (as the same was)<br />
bin stopped and seized for the Ciustomes due upon the same. And<br />
further cannot depose.
