Smith} '''Rp. 1''' '''William Marsh''' of Ipswich in the County of Suffolke<br /> Mariner aged 30. yeares or thereabouts a Wittnes<br /> sworne and examined saith as followeth videlict./ To the first Article of the said Allegation hee saith, That hee this<br /> deponent did never see nor observe the arlate Complaine nor any other on<br /> his behalfe take any view of the Vessell the ''Primrose'' arlate neither in the<br /> river of Thames nor elsewhere. And further cannot depose:/ To the second article hee saith, That hee this deponent never made any Contract<br /> or agreement with the said Complaine for or concerning the transporting of<br /> the goods in question, nor how much freight was to be payd to this deponent<br /> as master of the sayd hoy or vessell for the sayd goods, and he doth<br /> verily believe that there was not any contract touching the same.<br /> made by the sayd Complaine with the arlate Brandling, Stott or<br /> Blomfeild; for that he saith there never useth to be any Contract<br /> made for the transport of such goods to Ipswich, while the sayd goods<br /> were to have bene transported, but the freight being a sett and<br /> knowne price, goods are usually and ordinarily sent<br /> on board without any particular Contract or Agreement. And otherwise<br /> he saith he cannot depose. To the third article of the sayd allegation This deponent saith that att such tyme as the<br /> sayd Complayne sent this goods on board the sayd hoye, and att such tyme<br /> as she mett with the foresayd storme and tempest in her Course for<br /> Ipswich, she was well and sufficiently furnished and provided of all<br /> Tackle furniture and Apparell whatsoever fitt for such a vessell<br /> ánd such a voyage both for sayles, Cables, Anchors masts and other<br /> tackling whatsoever, and was a strong and tight vessell the tyme<br /> ánd tymes aforesayd, which he knoweth to be true being then Master<br /> of her, And beleeveth the same was and is well knowne, and was<br /> taken notice of by such persons as saw and knew her. And otherwise<br /> he cannot depose. To the fourth article of the sayd allegation, he saith that the last voyage or course that<br /> the sayd hoye made from Ipswich to this port which was immediately<br /> before the lading of the sayd Complaines goods in question, she brought<br /> to this port a lading of East Country goods and there delivered<br /> the same in good condition without any dammage and or other preiudice to<br /> the same, which he knoweth for that himselfe delivered the sayd goods,<br /> and for the reasons aforesayd is well assured that she might and<br /> would have carryed her lading from hence to Ipswich in safety in case she<br /> had not mett with the sayd extraordinary storme and Tempest in her<br /> passage thither.
