Transcription ánd deposeth that in or about the beginninánd deposeth that in or about the beginning of January last 1656 the shipp the<br /> ''Nicholas'' (whereof Claes Johnson was master) was off the Southwood Cape<br /> or Cape Saint Vincent taken and seized by this deponent and<br /> company in the ''Maidstone frigot'' in the immediate service of this Commonwealth<br /> and that the said shipp ''Nicholas'' had then aboard her besides other goods<br /> severall parcells of tobaccoe, which have since bin brought to this port<br /> in severall shipps, and saith that the said shipp the ''Saint Nicholas'' (as her<br /> company declared) then came from Santa domingo in hispaniola, and there<br /> (as her said company declared) tooke in the said lading of tobacco and<br /> other goods. And that the said Spaniards aboard further declared that the same<br /> namely the said tobaccoes and other goods were laden at Santa domingo<br /> by Spaniards, and were for the account of Spaniards, subiects of the<br /> king of Spaine or to that effect #, and were to be carried to and deliveres<br /> at Cadiz in Spaine or thereabouts in the king of Spaines dominions,<br /> and saith the said shipp the ''Nicholas'' was then in her course for cadiz<br /> or Santa Lucars, and would (in all probabilitie) have gone in thither if shee<br /> had not bein prevented by this deponent and company in the said frigot.<br /> And further that when shee was soe seized their were severall papers<br /> aboard her, which this deponent hath caused to be delivered into this<br /> Court; and hee and this examinate was informed that while the<br /> said frigot after the said seizure was in stormes and this deponent and<br /> company were busie upon the deck to prevent danger, the said Claes<br /> Johnson went into this deponents cabbin (whither all the papers that<br /> had bin taken in the ''Nicholas'' had bin brought) and tooke two packets<br /> and heaved them over board into the sea. And otherwise hee cannot<br /> depose.
