Smith Budd}<br /> Examined upon an Allegation<br /> on the behalfe of the said<br /> Minott and Sticke '''Peter Butt''' of Middle=<br /> borough in Zeeland Mariner<br /> Master of the sayd shipp aged 55 years or thereabouts<br /> sworne and examined saith as<br /> followeth videlicet/ To the first hee saith; That in the moneth of December last past the<br /> arlate Nicholas Minott and John Stricke Merchants of <br /> and Subjects of the ffrench king did at Bulloigne in ffrance by<br /> and take to freight the shipp the ''Waterhound'' arlate of and from<br /> this deponent then and now Master and Owner thereof and that for<br /> and upon a voyage to be performed from Bulloigne aforesaid to<br /> Roane in the said kingdome of ffrance, and thence to returne to Bulloigne<br /> and that by and according to the contents of a Charterpartie made by<br /> and between the said parties which Charterpartie being in this article alledged<br /> and exhibited and now showne unto him this deponent hee this deponent declareth<br /> and affirmeth to bee a true and authentique Notariall Counterparty<br /> or Copie Notariall of the origionall Charterpartie made between him <br /> this deponent and the producents aforesaid to the intent therein expressed and <br /> by this examinate predeposed. Which the premisses hee this deponent saith hee<br /> well and assuredly knoweth for that he was and is Master of the<br /> said Vessell and signed or subscribed the protocoll of the sad=id<br /> Charterpartie and thereby is well assured of the truth of the contents<br /> of the predeposed schedule of Chaterpartie. And further cannot<br /> depose, referring himselfe to said Chaterpartie/ To the second hee saith That in the moneth of ffebruary last past<br /> the said shipp being at Roane aforesaid the said producents being then <br /> and there personally present and for their owne proper use and accompt <br /> lade and putt on board the said Vessell the number of one hundred<br /> three and one halfe puncheons of wyne, sixteene potts of <br /> nutts and a great quantity of small fruit trees and a small bale of paper to bee carried<br /> and transported in the said shipp to Bulloigne aforesaid and there <br /> to be delivered to the said producents or to their Agents for their<br /> accompt.
