Captaine Woodgreene and company against}
the Ladie Guardian aforesaid}
Examined upon the foresaid allegation

John Sandys of London merchant, aged 24 yeares
or thereabouts sworne and examined.
To the first article hee saith that hee this deponent hath seene the
Commission of Captaine Woodgreene to the effect arlate, and knoweth
that hee had the same aboard at the time of the seizure hereafter
mentioned.
To the second article hee saith and deposeth that on Good friday last past
English stile, the arlate Isaac Woodgreene upon the high and open
seas in the shipp the African neere the Ile of Scio met with and
seized a certaine french shipp called The Lady Guardian or
Madona de la Guarda and her lading, and carried her to Smirna,
where her ffrench master and company got ashore and quitted
the said shipp which hee knoweth being present at the seizure and of
the carrying the said prize to Smirna, hee this deponent being Sopracargo
of the said shipp the African. And otherwise hee cannot depose.
To the third article and the schedule annexed hee saith and deposeth
that after such bringing the said prize into Smirna, Peter Martin
her ffrench commander appeared before the English Consul at
Smirna named Spenser Britten, and there freely confessed in this
deponents presence and hearing that the said shipp the Madona
Guardiana with her lading belonged at the time of her seizure to
ffrenchmen, subiects of the kinge of ffrance or ffrench kinge, and
for the further manifestation thereof hee subscibed the said schedule
annexed with his owne hand in the sight and presence of this
deponent. And otherwise hee cannot depose.
To the fourth hee saith that the said shipp the Madona Guardiana
and manned with ffrenchmen when shee was soe seized, And
otherwise hee cannot depose.
