Transcription

Purse about fower of the clock in the afternoone of that day the
sayd Cloase lighter soe came tp bee laden, did depart and foe home and
returned the next morning about seaven of the Clock which was as soone
as they could, being to come from London to Blackwall where the sayd
Shipp laye, And saith hee beleeveth noe person intrusted with a lighter which is stanch and stronge as the lyter in question was and is
taketh charge of the goods
[?the] though shee had received her full ladeing in, but some person of
the Company of the shipp which delivereth her ladeing goeth alonge therewith if it goe presently
away and taketh care of it when it is brought to the place appointed to
see the same delivered out, and in case a lyter bee not fully laden that
shee may depart with the first oportunitie of tydes the lytermen are
not tyed to watch with her nor lyable to make good the losse or other damage happening (if not through the insufficiency of the lyter but the laders ought to take care of her
and her ladeing till shee bee fully laden and alsoe to send one to see her goods
unladen And further hee cannot answere/

To the 6th Interrogatorie hee saith that hee this rendent (a little before his
and the sayd Purses goeing away as aforesayd at fower a clock in the afternoone)
did scoope out a little water which was in the well roome of the sayd
open lighter wherein the damage controverted happened, but by vertue of his
oath hee hath taken doth positively affirme, that the plugg of the sayd lyter was
in and fast as it ought to bee, and was noe way loosened by him this rendent
nor the sayd Purse, but the lighter was by them then left safe drye and
in good condition, and saith hee this rendent and the sayd Purse came noe
more to the sayd lighter till about 7 of the clock the next morning, nor
knoweth not, nor hath heard of any one else that did, and by what meanes
the sayd damage Interrogat happened hee knoweth not for that hee knoweth
the sayd lighter was by him this rendent and the sayd Purse left safe and well
and her plugg fast, and whether the sayd plugg were afterwards out or by what
means it came out hee knoweth not And further hee cannot answere/

jjohn Hodgkins of the parish of Saint Olave Southwarke
Lyterman aged 27 yeares or thereabouts a witnes
sworne and examined saith and deposeth as followeth
videlicet/

To the 1: 2: 3: 4th 5th 6th 7th 8th 9th 10th and 11th articles of the sayd allegation
hee saith and deposeth that hee well knoweth the liter wherein the damage
