A busines of Examination of wittnesses concerning
the dammage of goods susteyned in the shipp the}
Concord promoted by Richard Purvis and}
Company Owners thereof against Edward}
Badden William Travers and James Clarke}
Cheeke}

Examined on an allegation arlate bearing
date the 24th of October 1655 given in
and admitted on the behalfe of the
sayd Richard Purvis and Company./

John Hawley of Linne in the County of Norfolk
Mariner aged 30 yeares or thereabouts a wittnesse sworne
and examined saith and deposeth as followeth videlicet./

To the first 2 and 3 articles of the sayd allegation hee saith that hee well knoweth
for that hee went Gunner of her the same voyage that the arlate shipp the

Concord in her last voyage was a stronge and tight shipp and that the
Merchandizes and goods laden aboard her the sayd voyage were carefully and well stowed
And saith hee well remembreth that upon Sunday the sixteenth day of September
last past the sayd shipp off ff[?leckery] upon the Coast of Morway was about
fower of the clock in the morning of the sayd day surprised with a very violent
storme and tempest which continued with exceeding great violence
for the space of about eighteene howers or better which storme
during the sayd tyme was soe violent that by the force thereof the
boate belonging to the sayd shipp did beate with such violence against the
side of the sayd shipp being driven by the force of the sea that it
brake downe the wales of the sayd shipp and by the continuall beateing
of the sea upon the sayd shipp and washing over her decke the seames
of her upper deck did open and give way whereby shee receaved very much
water into her at the seames which were soe opened, and hee alsoe saith
that by the violence of the seas soe washing over her shee lost her sayd
boate and two of the sayd shipps company were washed off from the deck,
one of which, with much difficulty fott againe on board and was preserved, and
the other perished in the sea And hee further saith and deposeth that the Master
and Company of the sayd shipp seeing the violence of the sayd storme and
the great danger they were in by reason the sea runne soe often over
their decks and fearing the sayd shipp would not bee able to resiste the violence
thereof, but bee overwhelmed and perish therein, did for the better preservation of
his owne and his sayd shipps Companyes lives voluntarily heave over
board an Anchor, and a payre of grapplings, two [?boye] ropes, a topp
mast, a mayne yarde and mayne sayle, this hee deposeth for the reasons aforesayd
as alsoe for that hee helped to stowe the goods laden on board her
the sayd
