5. Examined upon the libell giuen in and admitted on behalfe of
6. the sayd Complaine

Thomas Coclough of the parish of Saint Christoper neere the stocks
London Grocer agede ˹36 or 37 or eight˺ yere or therabout, a wittnes sworne and
examined saith and deposeth as followeth videlicet

11. To the 3 article of the sayd Libell hee saith that upon the thirteenth day of
12. the moneth of October 1653 the arlate Titus Complayne did buy of
13. this deponent the foure hogsheads of tobaccoe arlate, for which the sayd Comp-
14. laine dide bargaine with this deponent to pay him for them and hath since
15. paid him for them fifty, five pounds foure shillings seauen pence and
16. the sayde Complaine ordered this deponent to send the sayd foure hogsheads
17. of tobacco to dice Key London to be shipped a board the key a vessell called
18. the Primrose of Ipswich of which ee hee sayd the arlate William Marsh
19. was Master and hee saith that shortly after they were soo bought and before
20. the seventeenth day of the sayde moneth of March this deponent sent them in a
21. Cart to dice Key and sent his seruant John Appleton with them to see
22. them deliuered to the sayd Marth, who accordingly went with them and
23. receaued the sayd hogsheads of tobaccoe at the sayde Key, and taken charge of
24. them till such tyme as he could shipp them with his sayd vessell. And hee
25. saith a goode while after the sayd moneth of October this deponent heareing
26. a reporte that the sayde Marsh his hoye was cast away, hee this deponent
27. went to the wharfengers man of dice Key and enquireth of him whether the
28. sayde 4 hogsheads of tobaccoe were by the sayde Marsh laden aboard his sayd
29. hoye, who affirmed to this deponent that they were laden aboard her
30. about the 17th day of the sayde moneth of October 1653 And further to
31. this article hee cannot depose./

32. To the 4th hee cannot depose./

33. To the 5th hee saith hee hath hearde the sayd Complaine[ant] saye that hee
34. nor any other for him or his use did euer pp receiue of the saud Marsh the sayd
35. 4 hogsheads of tobaccoe or any thing in liew of them And further hee
36. cannot depose. saving his subsequent deposition

37. To the rest of the articles 6th and 7th hee cannot depose/

38. To the 8th hee cannot depose

39. To the rest of the articles hee is not examined by direcc[ti]on of the producent

41. To the first Interrogatory hee saith hee has cometh to testifie he hath of the
42. knowledge in this cause being soo required to doe by the sayd Complaine[ant]
43. and saith it will bee neither profitt nor preiudice to him this rendent
44. which way soo ever his cause bee adiudged and that hee hath noe share or
45. interest therein nor in the vessell Interrogate./

46. To the 2 he saith hee knoweth not the Interrate Brandling nor euer sawe
