1. the sayd Tottie would not condescend, but required the
2. shipps company to goe on with ladeing the lighter, which
3. they, for the reasons aforesayd refused to doe, whereupon
4. the sayd Totty went on shoare and fetched some labourers
5. to lade the sayd lighter, and they being come on board they with
6. the helpe of some of the shipps Company did fully lade
7. the sayd lighter, and it being laden Totty send it away, And
8. hee saith that not long after huggery and Turpin the
9. Masters Mates seeing the master did not take Care to have
10. the shipp and goods surveyed, did procure two men by order
11. of the Trinity house to survey the sayd shipp and the goods
12. dammaged, after which survey made, the shipps Company
13. did readily performe their duties in unladeing the sayd
14. shipp when lighters came to fetch it this hee
15. deposeth of his sight and knowledge being one of the shipps
16. Company and further hee cannot depose./

17. To the 7th hee saith hee hath bin a Mariner for about fowerteene
18. yeares last and in that tyme hath made divers Merchandizing
19. voyages
20. and thereby knoweth and hath observed that Primage and
21. Averidge is paid and allowed to Masters and Mariners over
22. and above their wages and that it being paid doth binde them
23. to satisfie such dammages as happens to their ladeing by
24. imbezillment, ill stowage, want of pumpeing, or the like
25. neglects of theirs And saith hee sawe Totty receive primage
26. and Averidge of some of the freighters for this voyage in question,
27. and that hee hath paid noe primage nor Averidge to the deponent
28. for the voyage now controverted, nor as hee beleeveth to any
29. other of the sayd shipps company And further to this article
30. hee cannot depose/

31. To the 8th hee saith hee referreth him selfe to the
32. Registry of this Court and further cannot depose./
33. To the last hee saith his foregoing deposition is true/

To the Interrogatories/ [CENTRE HEADING]

36. To the first (the danger of piurie being declared to him as
37. the Interrogatories requireth) hee saith hee was one of the
38. Company of the Edward and John the voyage in question,
39. and that Tottey is sued for his wages amongst others by
40. this suite./

41. To the 2 hee saith hee hath heard and beleeveth that the Interrogate
42. Captaine Totty was at the Barbados sued for the horse
43. Interrogate, and condemned to pay for him, And further saving
44. his foregoing deposition hee cannot depose/
