Which day the said ffrancklin
appeared for the said Davies
Mitchell and Company and
made himselfe partie for
them and [?Faine] an allegation
in writing which the Judges admitted
soe farre as the same is by lawe
admissible Then the said ffrancklin uppon
the said allegation produced the said [?William]
Vincent as a party principall whom the Judges
receaved and administred an oath unto him to
speake the truth at the time of his answeareinge and
monished him to give in the same by wednesday
next./.

that the said Cooke and Johnson ought not by
lawe to have any wages for their service in the
said shippe the Tankervaile the voyage in question and
that the said Batson and Company ought to bee
dismissed from any further observation of Judgement
in this busines and did absolve and dismisse them
from the demannds made by the said Cooke and
Janson by this suite the said Clements dissentinge
et cetera and protesting of the nullity and greivance and
of appealinge./.

behalfe of the Commissioners for
examination of witnesses did

for them and not otherwise And then the Judges at
Smiths petition did decree publication of the said depositions
and decreed copies thereof Suckley dissentinge./.

absence of Mr Budd appeared for the
said Warner and made himselfe partie for
him and exhibited the originall mandate with the
certificate thereon indorsed and then appeared the
said Watson whome the Judges monished to give a full
and plaine answeare to all the articles of the libell given
against him in this cause and monished him to putt in the
same before the next Court day Then the said ffrancklin
