Which day the said Budd upon
the matter by him in this
cause given and admitted
produced for a witnes John Gibbs
whom the Judges receaved and administred
an oath unto him to speake the truth at the
time of his examination and havinge the usuall
time for Interrogatories/.

The Lord Protector against John}
Brewer Budd Smith}

Which day appeared personallie the
said John Brewer and Mr
Smith as proctor for him in whose
presence Doctor Walker Advocate for
his highnes the Lord Protector alleadged
that upon the twentith day of the month of
October 1652 the said John Brewer did buy of
th then Commissioners for prize goods eight Dry ffatts of
Argall then lying at or neare Buttolph Wharfe for
which hee undertoke to pay unto them for the use
of this Common wealth after the rate of 29 s per
hundred and six peeces Boxes of wrought lookinge
glasses containinge about seaventy glasses for which
hee undertooke to pay unto them 23 s 6 d per Glasse
and alsoe a parcell of decayed licquoris at Dice
key for which hee undertooke to pay unto them 20 s 6 d
per hundred and subscribed his name to a Booke
by them kept for that purpose in three severall
places as in the same is contained in the presence
of the said Brewer acknowledginge that hee did
buy of the said Commissioners for prize goods the time
aforesaid Eight Dry ffatts of Argall at 29 s per
hundred six boxes of wrought lookinge Glasses and a
parcell of decayed lickoris at the rates alleadged
according to the agreements mentioned in the said
booke which being showed unto him hee then acknowledged
to bee by him subscribed but alleadging that there
was noe Argall glasses or Lickoris at the places
aforesaid att the time of the makinge the said
Contract and agreement Whereupon the Court for
the discovery of the truth in this cause did order
that the late Commissioners for prize goods doe appeare in
this place upon this day sennight to declare whether
there were any Argall Glasses and Licquoris att
the places aforesaid at the time of the said
Contract and agreement or not, and what is
become of the same and to see further proceedings
had and made in this cause and monished the
said Brewer to bee then present in this
place./.
