of an Irish man of warr or pirate pretending a Commission from the kinge<br />
of Scotland, who had taken her about 9 or tenn of the clock of the same day,<br />
and had had her only five or six houres in his possession, and had taken<br />
this deponent and three men more of his company out of her, and had<br />
left only foure men and a boy aboard as prisoners, And<br />
otherwise hee cannot depose.
To the third Interrogatorie hee saith and deposeth that the said pirate<br />
was endeavouring to carry the said vessell and lading to Jersey when hee<br />
had taken them, but the said Captaine Clarke lying in the Roade<br />
of haver da Grace and seeing the said man of warr take the said vessell<br />
and another boyer that was in her company, hee made saile after<br />
and rescued them as aforesaid, the said pirate then flying for Jersey.<br />
And otherwise referring himselfe to his foregoeing deposition hee cannot depose.
To the fourth hee saith hee saith hee had only his accompt of his<br />
said lading aboard and noe other papers or writings, nor were<br />
there any throwne over board or concealed.
To the fifth hee saith that the said vessell the ''Saint Jacob'' came last from<br />
Roane before shee came to Newcastle to take in the said coales, and was<br />
freighted by none, but traded mearly for the said owners accompt<br />
under the management of this deponent as thereto imployed by them,<br />
and saith his company were hired and shipt at hamborowe and were<br />
and are all hamburgers and noe ffrench, and were to receive their<br />
wages of this deponent.
To the last hee referreth himselfe to his foregoeing deposition, and otherwise<br />
hee cannot depose.

'''Harman Vrede''' of hamborowe Stiersman of the shipp<br />
the ''Saint Jacob'' of hamborow, aged 37 yeares or thereabouts<br />
sworne and examined.
To the first and second Interrogatories hee saith and deposeth that the said vessell<br />
the ''Saint Jacob'' was taken and rescued by Captaine Clarke not farr from<br />
haver da Grace on or about the seaventh day of this instant moneth of<br />
August 1651 about two of the clock in the afternoone, when shee was laden<br />
with coales and had noe other marchandizes aboard her nor any money great<br />
guns armes or ammunition, which coales shee tooke in at Newcastle and<br />
was carrying them for Roane there to sell them for the owners accompt<br />
and saith that david vermalen, Cornelius da hartage, Walter Bassy<br />
Augustine, hendrick Martins, derrick Rey[XXs] and his precontest the<br />
Skipper were {are} and owners of the said shipp and lading, and were and are all<br />
hamburgers and there resident and Subiects of that State, and that hee<br />
this examinate hath noe part or share therein. And saith the said shipp<br />
belongeth to the said port of hamborowe and was built at Serdam<br />
in holland, and that to the time of the said Rescue the said shipp was in<br />
the power of and Irish man of warr who tooke her about tenn of the<br />
clock of the same day, and had taken the Skipper and others of her company<br />
out of her and kept the rest aboard as prisoners, and was carrying her<br />
and her lading for Jersey, all which hee knoweth being Stiersman of the said<br />
vessell and aboard her when shee was soe taken And otherwise hee cannot<br />
depose./
