1. To the 4th arle fifth ˹and 6th 7th and 8th˺ articles of the sayd allegation hee saith that the at the
2. tyme who the shipp the John and Mary arlate (whereof the arlate william webber
3. was Master) laye in the roade of Loratavo to lade wynes the voyage in question which
4. was in the moneth of November and december 1655, hee this deponent was then a
5. Marchant at Teneriff one of the Canarie Islands and sawe the sayd shipp lying
6. there and sawe the sayd webber severall tymes on shoare there during such her stay there
7. and saith hee well knoweth that there was at that tyme an imbargoe of all goods
8. there belonging to English Marchants and by reason of the sayd imbargoe hee this
9. deponent well knoweth that hee having then wines to lade upon severall English
10. shipps vist upon the Catherine ffrigott ˹of London˺ forease Russell Commander and upon the
11. Martine of London Roger Shapton Commander and upon the william and Elizabeth of
12. London Symon Tranckmore Commander XXXX before hee could bee admitted to
13. lade any wines upon sayd shipps was by the Generall and other officers of the
14. Kinge of Spain obliged and forced to pay Indulto money and did pay to them
15. Indulto moneth for the wines laden aboard the sayd three shipps videlicet forty two
16. Ryalls a pipe for every pipe of wine laden ˹by him˺ abroad the sayd Catherine ffrigott
17. and fiftie Ryalls a pipe for ever pipe of wine laden by him abroad the Martyn
18. aforesayd and sixty one Ryalls five quarts for every pipe of wine by him
19. laden abroad the william and Elizabeth a foresayd and beleveeth and is well
20. assured that all English shipps which receaved in any wines at Teneriff
21. aforesayd the voyage in question did pay Indulto money before they were
22. permitted to lade, according to such rates as the sayd gexerall and other officers
23. of Spaine and the marchants who were to lade the sayd wines could agree And
24. saith hee alsoe well knoweth that noe English marchants durst be known
25. to lade any wines as belonging to English men but made use of Spaniards
26. names or dutch mens names to lade the same wynes aboard in that soe they
27. might not bee knowne to belong to English men for feare of being seized
28. by the king of Spains officers as goods confiscate to the sayd king and hee this
29. deponent made use of the names of one Pedro Rivetie a Spaniard for lading
30. his wines a board the sayd three shipps, and beleveeth ˹the arlate Bevin and all˺ a there that laded wines
31. then did make use of the names either of Spaniards or duty to colour the ladeing
32. of them and preserve them from being seized and paid indulto money according
33. to their compositions And further to these articles hee cannot depose./
34. To the rest of the articles hee is not examined by direction of the producent

36. To the first interrogatoryhee saith hee came to testifie the truth of his knowledge
37. in this cause being for required to doe by Mr Walter Bevin on the behalfe of
38. the producent Travers and saith hee favoureth all English litigant and in this cause
39. a like and desyreth right may prevaile therein and saith hee hath noe share or
40. interest in this caused nor will it hee either profitt or preiudice to him which partie
41. soo ever prevaile therein./
42. To the 2 hee answereth negatively
43. To the 3 hee saith hee was not aboard the John and Mary the tyme Interrogate
44. And further hee cannot answere knowing actying of any noate ˹Interrogatorie nor˺ the contents thereof
45. And the 4th hee saith hee was not present when the interrogatory Travers or his Agents
46. paid by any Indulto money or agree to pay any nor knoweth what Indulto money was
47. paid by any but him selfe, but is well assured as a foresayd that all English shipps that
48. laded wine their factors marchants paid Indulto money according to the rates
49. agreed upon betweene the king of Spaines officers and them or alsoe they would not have
50. bin permitted to lade wines the voyage in question And further saving his forgoeing
51. deponent hee cannot depose./
