To all people to whome this psent writinge shall come, knowe yea, that I John South[1] merchant haveinge a reteined debt due and oweinge unto mee from one John Lambton Merchant att Suratt deceased, and haveinge sure & certaine intelligence that y:e said John Lambton had ?sent all goods & chattells & ready monies in y:e good Shipp y:e Suratt ffrigatt[2], I y:e said John South [South or Smith?] did uppon y:e fifth day of December nowe last past make ?sequestearox & estopell of five ?Baskitts of Twelve ?Shills conteininge one thousand eighty five pounds weight, fourteene Elephants Teeth conteininge Two hundredd forty six pounds and one thousand fifty six pounds weight of Bexxxx [Beamissy???] Beads togither with foure hundred and forty royalls of eight in ready monies bee itt more or lesse as y:e goods chattells and ready monies of y:e said John Lambton in y:e hands and custody of Robert Grosse Master and James ?Roames Purser of y:e same Shipp; and hereuppon afterwards yt:t is to say uppon y:e said fifth day of December nowe last past y:e said Shipp arrived in Swalley hole neare Surratt and uppon y:e unladinge and delivery of y:e said Shippe, y:e right Worshipfull S:r George Oxinden k:nt & president for y:e hono:ble East Inida Company by his order to y:e said Master and Purser of y:e said Shipp commanded y:e said goods chattells and readye monies to bee delivered into his hands and possession, And remaininge in y:e hands and custody of y:e said George Oxenden (sic) knight I doe therefore by these psentes make so sequesteraton and estoppell of y:e abovesaid goods chattells & ready monies in y:e hands of him y:e said S:r George Oxinden, And for y:e doinge of which I y:e said John South doe by this [??? Could be lre?] keepe indemnified him y:e said S:r George Oxinden from & against all and every person and persons whatsoever w:ch shall prtend and right tithe [?] interest or clayme to to any of y:e abovesaid goods chattells or ready monies ?soe as aforesaid sequestrdd estopped & ?detained in y:e hands and custody of him y:e said S:r George Oxinden for y:e propp ?use XXXXX and benifitt of mee y:e said John South untill itt shall bee legally and fairely trydd by lawes of y:e Realme of England as they are established And further in case a suite shall bee ?considered I y:e said John South doo by those psente covenant & engage to pay all damages costs and charges if any shall bee ?recommended by reason or XXXX of y:e detaining I here hereunto sett my hand and seale this Twentieth day of January in y:e yeare of our Lord 1663/4
