Transcription

said Batts account, and these Rendents beleeve that
the same were entred in the Boateswaines booke arlate
but where the said booke now is, these rendents nor
any of them doe not know. but they
beleeve that the 1500 peeces of eight mentioned in
their precedent answeares made to the fifte articel of
this allegation were entred into the said Middletons
Booke as receaived in part of freight as in their
said answeares to the said fift article of this allegation
whereunto they refer themselves is expressed And
otherwise they nor any of them doe not nor doth
beleeve the said pretended position to be true in any
part thereof.

To the sixteenth position of the said pretended allegation
they and every of them doe answeare and beleeve
that the arlate Thomas Middleton was never
required to signe and did not signe or deliver any
bills of lading for the pretended goods arlate And
that after the arivall of the said shipp to this
port of London the arlate Thomas Middleton
and these Rendents did procure the said shipps
lading to be arrested by vertue of a Warrant out of this
Court for and towards theire satisfaction for
the freight in this suite demannded and that after
the said arrest videlicet on the first day of July 1645
the said Batt gave bayle to answeare the
action and thereupon all the said goods soe
arrested were by the order and decree of this
Court discharged from the said arrest and were
all of them as they beleeve delivered to the said
Thomas Batt and into his possession and they
further referr themselves to the Registry of
this Court And otherwise they nor any Of them
doe not nor doth beleeve the said pretended position
to be true in any part thereof./
