the sayd Chests with table plate mentioned in the sayd third schedule arlate,
All for the sayd John Mexia de Herrera his owne proper use and Accompt
to be carryed and transsported from therre in the sayd respective shipps to
Ostend in Fflanders upon the sole Adventure of this the sayd John Mexia de
Herrera and there to be delivered to himselfe or his Agents for his use
and Accompt the premisses this deponent knoweth to be true by the declaration
of the sayd John Mexia himselfe at Cadiz whom he knoweth to be the true
of the sylver as aforesayd, and standing upon the shoare or Strand
att Cadiz where he save the money and plate laden on the respective shipps
as aforesayd, putt into severall boates, and saw the boates arrive at the sayd
shipps respectively and att theire retturne saving the papers of receipts
wherein the sayd Masters acknowledged to have receyved and taken
aboard their respective shipps the moneys in manner above
specified. And he further saith that the sayd John Mexia de Herrera
together with the deponent shipped himselfe in the Saint George aforesayd
to come along in her from Cales to Ostend and was in her together with
this deponent at the time of seizure by the Parliaments shipps. And
further he cannot depose.

To the third he saith that after the lading of the sayd moneys and plate and
goods as aforesayd, the sayd Shipps Salvador Salvador and Saint George vist
about the beginning of October 1652 did depart and set sayle from Cales
towards Ostend and in their course thither moore the Downes were taken
and surprized by some of the Parliaments shipps and brought up to this port
of London, And saith that att the time of the sayd surprizeall the aforesayd severall
and respective parcells of money sylver and other goods were and remained
aboard the sayd respective shipps, and by meanes of the sayd seizure came
into the possession of the Takers, this deponent being aboard the Saint George
att the seizure aforesayd and having in her sayled in Company with the other
Shipps into or were the Downes as aforesayd.

To the fourth and fiifth Article of the sayd Allegation he saith and deposeth
that after the lading of the sayd money plate and goods as aforesayd videlicet
upon or about the thirteenth day of October 1652 new stile he this deponent
being aboard the sayd shipp Salvador in the Bay of Cadize then and there
saw him master of the sayd shipp Christian Cloppenburgh signe three
Bills of lading all of one tenor for the Chest of Ryalls of eight laden
aboard the Salvador as aforesayd whereof the Bills of lading having this
name Christian Cloppenburgh att the foot thereof annexed to the allegation
and now showne him is one, and was delivered to the sayd John Mexia
de Herrera to carry along with him, and one other of the same tone was then
left with and aboard the sayd shipp Salvador. And he verily believeth
that the arlate Otto George about the beginning of October aforesayd laden
aboard the Sampson, and that the sayd John Martindorp about the same
tyme signed three bills of lading all of one tenor for all the goods plate
and sylver laden aboard the Saint George as aforesayd the sayd chests or trunkes of
table plate with table linnen only excepted, for that he this deponent
saw two bills of lading in the hands of the producent aboard the
Saint George having the name of the sayd Captaine att the foot of them
respectively vicdelicet one of them the name Otto George and the other the name John Martindorp he this deponent well knowing their character and manner of
writing, And saith he is assured that the Bills of lading to the
allegation annexed one signed Otto the other John Martindorp. and now showne him are the very same Bills which he
saw in the possession of the producent a ship board as aforesayd, And further
referring himselfe to the Acts of this Court he cannot depose.
