Transcription

To the last article he saith his former deposition is true.

Budd dt.

To the Interrogatoryes. [CENTRE HEADING]

To the first Interrogatory he answereth negatively to all.

To the second and third Interrogatoryes he answereth that he
referreth himselfe to his former deposition And otherwise or
further cannot answeare./

To the fourth Interrogatory he answereth that the interrate Anthony
Streete was in Sally after the shipp interrate was brought in
thither, and that he hath heard the said Streete bemoane his
condition having lost his shipp and being a Captive, but that
he never heard him speake of Alderman ffredeerick, And
further he cannot answeare.

To the fifth Interrogatory he referreth himsewlfe to his former deposition
and further cannot answeare.

To the sixth he answereth that the interrate Street being a Captive
twas improbable how he showld hope to obtaine the release of
his shipp And otherwise cannot answeare.

To the seaventh Interrogatory he answereth that he well knew the
interrate shipp the Returne, that she was of the burthen of
about eighty Tonns, But to the rest of the said Interrogatory
he cannot answeare./

John Rue of Northum nigh Barnstaple in
the County of devon Mariner, aged about 32 yeares
a wittnes produced and sworne and being examined
deposeth and saith as followeth./

To the first article of the sayd allegation given in and
admitted on the behalfe of the sayd John Ashwyn he
deposeth and saith that he this deponent was in the months
arlate a Captive or Slave in New Sally, and that in one
of the said months and to the best of his remembrance in
October 1654 the hull of the shipp in controversy was
brought in there, And that he this deponent was told by some
of those that brought her in, that they found her floating
upon the Sea having noe person aboard her about fower
or 5 Leagues off of New Sally And further he cannot depose.

To the second Article he deposeth and saith that after the
seizure and bringing into Salley the shipp arlate the aforesayd
John Ashwyn did buy her (she being exposed to sale) of the
Gvernour of the place, and that in payment for the said
shipp now in controversy, he the sayd Ashwyn parted with a
shipp called the Returne and with money to boote. And
he deposeth that he well knowing the said shipp the Returne,
she was worth in his estimation 300 li lawfull English
money And further he cannot depose.
