To the 12th hee cannot depose/

To the 13th hee saith hee referreth himselfe to the Registry of this Court
and further cannot depose/

To the 14th hee saith hee referreth him selfe to his foregoeing deposition and
to the lawe and further cannot depose./

To the 15th hee saith the sayd Constant is commonly reputed a subiect
of this Commonwealth and is subiect to the Juristiction arlate as hee
beleeveth and further hee cannot depose./

To the last hee saith his foregoeing deposition is true./

William Smith of Kingston upon hull in the County of Yorke
Mariner Pylott of the shipp the William of Gainsborowe aged
fifty five yeares or thereabouts a wittnesse sworne and examined
saith and deposeth as followeth videlicet./

To the 1 article hee saith that in the moneth of September arlate 1655 the arlate
George huntingdon was and is Master of the shipp the William arlate and had the care
and charge of her as Master and saith hee beleeveth hee then was and now is
commonly accompted a part Owner of her And further to this article hee cannot depose

To the 2: 3: 4th and 5th articles of the sayd libell hee saith the tyme arlate videlicet on the
eighteenth of this instant September being Tuesday the shipp William arlate laye
conveniently moored at Tower wharfe where shipps usually lye and was the outer=
most of three shipps there lying moored a brest videlicet there was the Sarah and an
other shipp moored a brest betweene Shoare and the William who made the third shipp and lay
on the oute side. And saith hee hath used the sea these 40 yeares last or thereabouts and hath often
moored in that tyme at Tower wharfe and thereby knoweth it is not usuall for shipps to lye
moored there more then three a brest, nor ought more then three a brest to lye there,
which notwithstanding the Master of the Waterhound (whose name
as hee hath heard is Nicholas Constant) and his Company came in the night tyme next
after the sayd 18th day and moored his shipp the Waterhound on the outside of
the William soe that fower shipps then lay a brest, which the arlate George huntington
and company perceiving did as in such case is accustomed put out their fenders to preserve
their shipp the William as much as might be (shee being but a smale shipp of about
forty tonne and then empty, and the Waterhound being a shipp of greater burthen
videlicet of about threescore tonnes burthen and laden with corne) and after the sayd
Waterhound had a while layne on the outside of the William hee this deponent
perceiveing the Master and Company of the Waterhound were about to lust their
sayd shipp inward toward the William, spake to the sayd Master and told him
if hee lusted his sayd shipp inwards it would bruise and hurt the William
and desyred him to forbeare soe doeing or to that effect whereto the sayd Master of the
Waterhounde answered and sayd hee came thither with intente to lust
his shipp inwards there, and there hee would lust her inwards, and that hee cared not
two pence though hee sunke the William or words to that effect, and there upon
did cause his company in a wilfull manner to lust his sayd shipp Waterhound
inwards, by meanes whereof the William being then a floate as the tyde fell away the Waterhound did beare
in upon the William and forced her upon the vessell that lay next her on the
