Transcription

had really bought and that the said Brewer would deliver the said oiles,
sold the same to Alderman [?diXXX], and hee beleeveth that
the said Day expecting not to receive or have any more or other
than the ordinary gage of 236 gallons to the tonne, intended to deliver
after the same gage to the said Mr [?direr]. And otherwise hee
cannot depose.

To the seaventh hee saith that the said John Day sent to the said John
Brewer by the hands (as hee remembreth) of him
this deponent a note for transferring the said oiles to him or to Mr
Alderman [?direr], that soe the same might be received from the
Commissioners for prize goods, and this deponent sawe the said
note delivered to the said Mr Brewer upon the Exchange, and
sawe the said Brewer receive the same. And otherwise hee cannot
depose.

To the 8th hee cannot depose.

To the 9th and tenth hee cannot depose, saving as aforesaid.

To the Interrogatories formerly administred. [CENTRE HEADING]

To the first hee saith that hee cometh required by Mr Rowe
to testifie in this cause, And otherwise negatively for his part
saving as aforesaid.

To the second hee saith that in all the said time of 8 yeares that
hee hath dwelt with John Day, 236 gallons of sweete oiles
to the tonne hath bin the usuall and accustomed gage, and hee
hath knowne many parcells bought and sold, and deliverie
made after that gage, and never knowne any sweete oiles bought sold or
delivered at 252 gallons to the tonne, or at
any other gage than 236 gallons to the tonne. And otherwise
negatively saving as aforesaid.

To the third hee hath not soe deposed.

To the last hee cannot depose.

To the Interrogatories last administred. [CENTRE HEADING]

To the first hee saith hee was not (to his remembrance) present
at the agreement interrogated, And otherwise saving as aforesaid
hee cannot answer.

To the second hee saith hee did not see the said Day pay any
moneys to the said Brower for the said oiles; and saith hee read the
note interrogated for the transferring the said oiles and to his best remembrance
weote the same, but doth not remember the words thereof. And
otherwise saving as aforesaid hee cannot answer.

To the third hee hath not soe deposed./

To the 4th negatively.

To the 5th negatively for his part, and otherwise cannot answer
