To the 12th hee saith that the said man of warr the [?XXX] aforesaud besides
six guns as aforesaid, carried about two or three and fiftie men, and was
provided with warlike provision of powder, swords muskets and other
warlike munition, and was a shipp of a square sterne, but the ffalcon
was not of above 60 tonnes or thereabouts, and had only five men or
mariners for her company, videlicet this deponent and foure men and noe more
and had not not carried any peece or peeces of ordnance, nor was [?XXX]
for amy considerable resistance, such that the were not able in any [?dXX]
to withstand or hinder the said man of warr from committing the violence
and spoile predeposed, or carrying away the said goods soe by the
company thereof plundered and carried away as aforesaid. And further
hee cannot depose.

To the thirteenth article hee saith and deposeth that upon the inlading and
deliverie of the goods in this port, three peeces of browne linnen and a
peece of white linnen, and the forsaid box marked with the foresaid
eighth marke, being unladed and delivered out of the said shipp, are taken
and put into the Customwarehouse and there left, in regard they
are not demannded by any, and are there ready to be delivered to
such persons as have or shall have authoritie to receive them
And further hee cannot depose.

To the Interrogatories.

To the first hee saith hee is of himselfe worth 100 Rix dollers though hee [?XXXX] and that his wages
are not unpaid, and touching the rest hee hath satisfied himselfe in his
foregoeing deposition to which hee referreth himselfe.

To the third hee saith the falcon had noe armes at all nor meanes of
defence, and otherwise hee referreth himselfe to his foregoeingd eposition
and dsaving the same answereth egativelt.
