who submitting themselves et cetera obliged themselves et cetera for the said Thomas
Burton in the summe of 200 li of lawfull money of England to the said
executor and administrators with the will annexed of the said Richard
Warner deceased to restore the said shipp now called the hunter but
formerly called the Peter incase the same shalbe adjudged by this Court to
the said executor and administrators aforesaid or the value of the said shipp
according to the appraisement thereof to be taken by authority of this Court
and to pay such expences of suite as the said Burton shalbe condemned in

Which day appeared Mr Smith for the
said Thomas Broadgate and made
himselfe party for him and alleadged that
14 tunns and a quarter of a tun of oyle
brought to this port of London in the said
shipp the hart ffriggott and in this
behalfe arrested did at the time of the
arrest in this behalfe made and still doe
belonge unto the said Thomas Broadgate
and the same were consigned unto him by bill
of ladinge and that he is in the possession thereof
and offered to give security to answeare any action his
said Excellency the Lord Ambassador hath against the
said Oyles whereupon the Judges did decree the said oyles
to be released from the arrest he the said Broadgate first
givinge security in this Court to restore the said 14 tunnes and
a quarter of a tunne of oyle if the same be extant or els to
pay the value of the same according to the appraisement thereof
to be taken by authority of this Court in case the same shalbe
adjudged to the said Lord Ambassador and to pay the expences of suite
in case the said Broadgate shalbe overthrowne Then the said Smith
produced for sureties Richard hambden of the parish of Saint
Gregories London draper and John B[?recoon] of the parish of Saint
Nicholas Coleabby London merchant who submitting themselves et cetera
obliged themselves et cetera for the said Thomas Broadgate in the summe of
1000 li of lawfull money of England to his Excellency don John Rodrigues
de Saa Manezooz Lord Ambassador for the king of Portugall to the
effect before expressed And unles et cetera Which caustion the Judges receaved
and did decree a Comission for the appointment of the said Oyles to Comissioners
to be named on both sides in case the said Suckley shall name by to
morrow noone./.
