IN THE NAME OF GOD AMEN, I HUGH Gayer of Plymouth in the Countie of Devon Marchant beinge sound of mind and perfect of remembrance thankes be unto Allmightie God, doe make and ordaine this my last will and testament in maner and forme following that is to ?say

FFIRST touching my soule I commend to the mercifull hands of Allmightie God the Creator of all things hopeinge by the onely merritts death and sesurrection of his sonne Jesus Christ and through faith in him that the same after theXX dissolucon of my bodie shalbe made partaker of his everlastinge kingdome in heaven And as touchinge my bodue w:ch is fraile and transitorie I committ the same to the earth from whence it came to be bruied where it shall please my Executrix

ITEM I give and bequeath unto the poore of Plymouth five pounds to be distributed as it shall please my overseers

ITEM I give unto my servants Elizabeth Andrewe and Margaret Cornish to each of them twentie shillings to be paid by my executriy if they be servinge with me at the tyme of my death

ITEM I give and bequeath to my five children John Gayer Margarett Gayer Johane Gayer Prudence and Robt Gayer to each of them two hundred pounds to be lett out & imployed for them and theire benefitt when or as soone as my Executriy shall gett in those my debts and adventures that are abroad in divers places And if any of my said Children shall happen to die before they shall accomplish and be of the age of one and twentie yeares or be married then the porcon of him or her soe dyinge shall remaine solely unto my sonne John Gayer but if he chance to die before he shall attaine to the age of one and twentie yeares then his porccon shall remaine equallie betweene the rest of my children that shall then be liveing And further my will is that every of them shall give towards theire maintenance unto theire mother five pounds yearely out of every of their porconns that shalbe imployed for theire benefitt as aforesaid And if any of the rest of my Children shall happen to die after y:e death of my said sonne John then the porcon of them soe dyinge sgalbe equallie devided amongst the rest of my Children surviveinge

ITEM I give and bequeath unto my deare wife Johan Gayer seaven hundred pounds And I make her my whole and sole Executrix of this my last will and testament

ITEM I give to my sonne John All my plate implements and houshold stuffe whatsoever PROVIDED alwaies that my wife duringe her life shall have the use and occupacon thereof And if my said sonne John happen to die before he shall accomplish the age of one and twentie yeares Then I give my said plate implements and houshold stuffe unto my sonne Robt Gayer And if he die before he shall attaine the age of one and twentie yeares Then I give the same unto my daughters to be equallie devided amongst them And I desire my ffather Thomas ffownes Esq:r Phillip Andrew John Waddon Robt Trelawnie and my brother Humfrie Gayer to be the Overseers of this my last will and testam:t and to see my will in all things performed And if any of my debts or adventures prove badd or miscarry in comeing home Then my will is that my wife and children shall every of them proportionably beare theire partes of such losses in theire legacies soe bequeathed them as aforesaid As in the discrecon of my overseers shall be thought fitt And this I publish to be my last will and testament revokeinge all former

Sealed & published in the presence of Thos Andrewe Xatschener Rowe Before the saeling and delivering thereof I further give unto my two maid servants twentie shillings more to each of them thew their formerly I havegiven And I give unto the poore of XX XXXXXX five pounds And I give unto the poorer portion in XXXmouth twentie pounds And my will is that if my estate the plate and houshold goods excepted doe amount unto more than seaventeene hundred pounds the overplus shall goe to the payment of my legacies given And if therebe amt more to be devided equallie between my wife and all my children And in case it come not to seaventeene hundred pounds Then my wife and children shall paie my legacies out of theire portions equallie

A CODICIL ANNEXED TO THIS MY LAST will and testament I doe further give unto Johan my wife the moyetie of the garden I purchased of Walter Giford the younger for her life The remainder thereof to John my sonne , and the heires males of his bodie the remainder thereof for default of such issue male to Robte my sonne and the heires males of his bodie And for default of such issue the remainder thereof to my right heires forever And as for the other moietie which I have likewise bought of S:r ffrancis Drake Baronnett, but have not as yet any assurance thereof my will and meaninge is that my said wife shall have it during her life the remainder thereof to my sonne John and the heires males of his bodie The remainder thereof to my sonne Robert and the heires male of his bodie, the remander to my right heires for default of such male as aforesaid And my will is my Executrix paie the fine thereof to S:r ffrancis Drake which is fiftie pound in case I die before it be paid
