IN THE NAME OF GOD AMEN the sixteenth day of November Anno Dom one Thousand six hundred and fforty two I James Ashe of Wittcombe w:thin the Parish of Battcombe in the Countie of Somerset gent. considering the ffrailty of this mortall life and the certainty of my death doe in perfect health and memory (God bee praised) make and Ordaine this my last Will and Testament in manner and forme following (That is to say)

I Comend my Soule into the Hands of Almighty God my Creator whom I deliver for his infinite mercyes sett forth into his love and to place itt in the Company of the Saints and blessed Angells in Heaven and my body I comitt to the earth whereof itt was made in full assurance at the generall day of Resurrection to receive the same againe united to my Sowle not as yet heere upon the earth vile and mortall but a gloriousand immortall body in all points like unto the glorious body of my Saviour Jesus Christ

ITEM I give and bequeath unto the Church of Batcombe XXX Parish Church the sume of Sixteene poundes to bee layd out by mine Executrix in a silver Flaggon to hould up at for the Communions there to be celebrated

ITEM I give and bequeath to the poore of the Church of Batcombe and Wetcombe the Sume of ffive poundes

ITEM I give and bequeath unto the people of the parishe of Xraham the Sume of Forty shillings

ITEM whereas I am possessed of diverse Chattels Leases Rentes or Leases with landes within the Mannor of Westcombe for diverse yeares yet to come my will is and I doe hereby give and bequeath the use bennefitt and occupacion of the said Lease house XXXX unto Grace my wyfe for soe manyas she shall live and after the decease of the sayd Grace my wyfe I doe give and bequeath all my Rights interest and remaynder of the terme of yeares as and in the says Leasehold landes togeather w:th the severall Leases thereof unto John Ashe my eldest sonne for and during the severall and respective termes that shalbe to come and unexpired in and uppon y:e severall and respective Leases thereof

ITEM whereas I am allsoe possessed of a Tennement in XXXham for the lives of Edward Ashe and Jonathan Ashe my Sonnes my will and meaninge is that if they or eyther of them shall happen to live to enioy my Sayd Tennement at Bxxham (which I hope they will) that then they the sayd Edward Ash and Jonathan Ashe as the same shall successively fall once them shall yearly part unto my daughter Alice Harris the wyfe of M:r Edward Harris or her Assignes for and during the terme of her lyfe the summe of Thirtye poundes p Anno

ITEM I give unto my sonne Edwarde the Summe of one hundred poundes and doe forgive him the Summe of ffive hundred poundes more which hee owith mee by bill

ITEM I give unto Joseph Ash my third sonne the Sume of ffive hundred poundes of Currant English money and I doe forgive him the Summe of ffive hundred poundes more w:ch he oweth mee upon bond the which bond my will is shalbee delivered up unto my sayd Sonne to bee Cancelled

ITEM I give unto my fourth sonne Jonathan Ashe the Summe of one Thousand poundes currant English money ITEM I give and devise unto Samuell Ashe my ffifth Sonne All my land in Stovell which I have allready passed and assured unto him by deede:s the which assurance my will is shall stand and bee effectuall and I doe

Hereby ratifie and confirme the same unto him according to the trew meaninge of the sayd Deede

ITEM I give and bequeath grazi unto my Sonne Samuell the Summe of a Thousand poundes of Currant English money

ITEM I give and bequeath unto my Daughter Anne M XXXX (Or, WXXXX) the Sume of three hundred poundes of Currant English money All w:ch said severall Somes of money given and bequeathed for legacyes aforesaid my will is shalbee payd to the sayd Legatees by mine Executrix w:thin twoe yeares after my decease

ITEM I give and bequeath to my Grandchildren and to every of them XXXX [BLANK IN ORIGINAL MANUSCRIPT] poundes a peece of Currant English money and to my Grandchild which I have at the time of my decease XXXX [BLANK IN ORIGINAL MANUSCRIPT] poundes poundes A peece w:ch sayd Legacyes my will is that myne Executrix shall pay out as followeth (viz:t) unto the male Children when they or any of them shall accomplish the Age of One and Twenty yeares and unto the ffemale Children when they attaine the age of sixteene yeares or day of Marryage or at any other timebefore if myne Executrix shall soe thinke good and may have a sufficient discharge for the payment of their Legacyes And my further will and meaning is that in Case my Sonnes Edward Ashe and Jonathan Ashe shall refuse to pay the said Annuytie or yearly Sume of Thirty Poundes p Anno unto my said Daughter Harris that then they take noe bennifitt of my Legacy given unto them by this my last Will Ass other my goods bennefitt and Chattells moveable and ymoveable not hereby given or bequeathed my debts and funerall Chardges deducted I give and bequeath unto my loving wyfe Grace and doe hereby make and ordaine her my full and sole Executrix of this my last will and Testament and doe make and ordayneThomas Strode of BowlXX and William ?Xhoord (??Choord) of Batcombe Overseers thereof and doe give them for their paynes Twenty shillinges a peece

MEMORANDUM that the said James Ashe late of Batcombe in the County of Somerset gent beinge of pfect mind and memory made and declared his last will and Testament in writinge bearing date the sixteenth day of November one Thousand sixe hundred fforty and twoe and did therin amongst other thinges give and bequeath unto every one of his Grandchildren the sume of one hundred poundes and unto every one of his great Grandchildren the Sume of ffifty poundes and did in the presence of diverse credible witnesses subscribe seale publish and acknowledge the said will for his last will and Testament w:th the sayd words hundred to his Grandchildren and ffifty to his great Grandchildren a peece therein xxxxted And his will mind and riall intension was that every one of his Grandchildren should have a hudnred poundes a peece and that every one of his great Grandchildren should have ffifty Poundes owt of his estate and of his sayd will did name constitute and appoint Grace his then wyfe his sole Executrix and the said Testato:rs did afterwards oftentimes say and confesse and acknowledge that hee had made his will and had therein given and bequeathed to his Grandchildren a hundred a peece and unto his great Grandchildren ffidty poundes a peece or to that effect And the said Testator did in the time of his last sicknesse whereof hee dyed when hee was of perfect mind and memory declare and say that next day his children were payed or provided for his Grandchildren and great Grandchildren should bee payd or to that effect in the presence of Credible witnesses Now for that the sayd word hundred and the sayd word ffifty are after the death of the sayd Testator found raised and scraped out in the said will xxx the subscribing sealing and acknowledging thereof without appearance of any due proofe that

The said repetitive words were were soe rasen and scraped and by the said Testator nor by his Questions the sayd Grace Ashe the Executrix aforesaid Each accept the sayd will with the sayd word ??hundred and alsoe the sayd word ffifty as they were inserted therein before the Sealing and declaring and acknowledging thereof and will performe the same accordingly as by xx xxx xxx done in case the sayd words had not been rasen or scraped out of the said will
