Transcription To the Interrogatories [CENTRE HEADING] TTo the Interrogatories [CENTRE HEADING] To the first (hee shath bin putt in mind of the danger of an oath) And [?hee GUTTER]<br /> saith and answereth) by vertue of his oath. that hee hath lived in England for [?five] yeares<br /> last past or thereabouts, and before hee was upon the voyage and imployment aforesaid) in<br /> the Barbadas, Spaine and Barbarie for two yeares or thereabouts<br /> last before that, And saith hee equally favoureth the parties litigant in the [XXXX] of the[?ire] cause<br /> , ffor hee saith that if [XX XXX GUTTER]<br /> beare any malice in testifying in this cause he might have inferred [XXXX] passages<br /> done unto himself by the said Middleton in the time of the said voyage, which hee now<br /> forbeareth to relate, And further cannot answare./ To the second hee answareth negatively to every [?particular] thereof To the third hee answareth that hee conceiveth that hee is not bound<br /> to declare his Estate as hee is a wittnes in this cause, And that he hath not received [?any GUTTER]<br /> reward nor doth expect any proffitt or advantage about the same And otherwise<br /> he answareth negatively. To the fourth hee answareth negatively to every particuler in the said Interrogatory<br /> mentioned. To the fifth hee answareth negatively as aforesaid To the 6th hee answareth that hee did goe or saile in the said shipp during<br /> the voyage in question, (as ffactor or Supra Cargo) of the said Cargazon<br /> in manner as before hee hath deposed, [?mentioned] in his depositions<br /> to which hee referreth himself and more hee cannot answare. To the 7th hee saith that hee is a Merchant by profession and hath bin<br /> (before the voyage in question) in the Streights) but [?now] att Tituan before<br /> the last time in the said voyage otherwise answareth negatively./ To the 8th hee saith that in some parts of Spaine opposite to Tituan<br /> Tobaccoes are held Contrabanda goods and such as were prohibited<br /> in some Ports of Spaine, (without License from the Estanqui[?r]o of ff[aXXX GUTTER]<br /> of the King of Spaine, and that the[?re] were Tobaccoes (so prohinited) in the said<br /> shipp when she lay in the Roade of Tituan, And hee conceiveth that at that time<br /> the Levant or Easterly wind did blow, but not so hard or feirce, but (as [XXX GUTTER]<br /> said) hee might have kept the Roade or att least not have gone out of the Streights<br /> but that also the said Middleton might have stopt in Gibalthar (sic) Roade as other shipps<br /> in the like case have done, And so have returned to Tituan within<br /> two or 3 dayes at most, And hee saith that after the said Middleton with the said shipp<br /> went from the Road of Tituan hee returned thither againe fifteene<br /> dayes after or thereabouts as hee remembreth And more hee cannot answare./ To the 9th hee saith that hee remembreth moe [XXX GUTTER]<br /> men Interrogate by their names unlesse it were ffleetwood if hee were the [XXX GUTTER]<br /> Carpenter of the shipp And further saveing his foresaid depositions to which hee<br /> referreth himself hee cannot answare or depose./.
