Marriner aged 30 yeares or thereabouts sworne and Examined.
To the first article of the said Allegation hee saith and deposeth That hee this deponent<br />
well knoweth the Shipp the ''Morning Starre'' arlate and hath soe done by the<br />
space of about eleaven or twelve yeares att which tyme shee was of this deponents<br />
knowledge built at Hamborough. And saith that the arlate<br />
Michell van Lubkin by the space of theise five yeares last past<br />
hath bin and still is Commander of the said ship which hee saith hath ever<br />
since the first building thereof belonged to Hamborough and unto the<br />
Now owners thereof and Company all liveing in Hamborough. which hee knoweth to bee<br />
true hee this deponent haveing bin for the said space of five yeares<br />
and upwards belonging to the said ship as one of her Company and dureing the terme<br />
of this her last voyage was Quarter master of and abord her and being himselfe borne<br />
and bredd within five miles of Hamborough and for theise 12 yeares hath dwelt there<br />
And soe much<br />
hee saith is true and Notorious in and about the Citty of Hamborough and places<br />
adiacent thereunto. And further cannot depose.
To the second and third articles of the said Allegation hee saith and deposeth that within<br />
and for all the tyme arlate and at the time of the seizure of the said ship the<br />
''Morning Starre'' the arlate Adrian Yonker Michael and Joachim Hewishe Antonio<br />
and Guilermo Lavistraet, Cornelius de Hertoge together with his precontest<br />
Michael Van Lubkin were and are the true and Lawfull owners and<br />
Proprietors of the said ship the ''Morning Starre'' and of her Tackle<br />
apparrell and furniture, And for such were and<br />
are comonly accompted and reputed Every of which said persons were<br />
and are Hamburghers and free Burghers and subiects of that<br />
Citty and State where this deponent hath knowne them to dwell<br />
many yeares before hee served on his shipp And for and as such they the said respective parties were and<br />
are comonly reputed and taken And further cannot depose
To the last hee saith his foregoeing deposition is true.
To the Interrogatories./ [CENTRE HEADINg]
To the first Interrogatorie hee saith that hee this Examinate was on bord the<br />
''morning starre'' when shee was seized and hath belonged to her about these<br />
five yeares and came first on bord her at Hamborough And further<br />
cannot depose.
To the second Interrogatorie hee saith that the said Adrian Yonker hath formerly lived in<br />
Saint Catherine Streete in Hamborough but in what particular streets by name the<br />
rest of the said Owners doe now dwell in Hamborough hee saith hee<br />
cannot particularly expresse. his memory not serveing him soe to doe, but<br />
saith hee did formerly knowe all theire howses and habitations and were all within<br />
the said Citty And otherwise referring himselfe to his foregoeing deposition<br />
hee saith hee cannot depose./
