of which Garret Clawson is master}<br />

Examined upon the sayd allegation.
'''Garret Clawson''' of dunkerke in<br />
fflanders master of the sayd shipp<br />
the ''ffortune'' aged 48 yeares or<br />
thereabouts a witnes sworne and examined<br />
deposeth and saith as followeth videlicet
To the first Article of the sayd allegation This deponent saith that he this<br />
deponent in the yeare 1651 and in or about the moneth of Aprill of<br />
the same yeare by the order and for and on the behalfe of the<br />
arlate William Meurin did contract agree for and really buy<br />
for five thousand four hundred and fifty livers or guilders the<br />
arlate shipp the ''ffortune'' whereof this deponent is master, which shipp<br />
att that tyme was called the ''golden Akorne'', and was so bought<br />
by this deponent of and from the arlate Reyner Johnson of<br />
hartlinghem in ffreezland who was then in possession of her<br />
as master and gave out and pretended that he had power from all<br />
his owners to make an absolute sale thereof, And saith that hee<br />
this deponent having so bought her offered himselfe ready to pay<br />
the sayd money in behalfe of the sayd Meuryn, and demaunded<br />
possession and delivert thereof to be made, but saith that by reason<br />
of an Arrest which it seemes unwitting to this deponent lay upon<br />
the sayd shipp for monety that had bene taken upp in the East Countrey<br />
upon bottomery, and severall incumbrances incident thereunto, the<br />
sayd shipp was not nor could be then delivered to the sayd Meurin<br />
or this deponent on his behalfe although he this deponent as aforesayd<br />
did desiire and endeavour it and offered himselfe ready to<br />
pay the money contracted for as aforesayd. And otherwise cannot<br />
depose, saving that he this deponent hereupon did by order with the consent<br />
and in the name and on the behalfe of the sayd Meurin cause an Arrest to be made<br />
upon the sayd shipp to the end noe other person might buy her<br />
to the preiudice of the foresayd contract.
To the second article of the sayd allegation this deponent saith that after such<br />
tyme as the sayd shipp had layne about 28. monethes under the sayd<br />
William Meurins arrest Notice was given him the sayd Meurin that the sayd shipp<br />
now called the ''ffortune'' formerly the ''Golden Acorn'' should be<br />
delivered to him according to the foresayd contract, And thereupon he<br />
this deponent by order of the sayd Meurin in the moneth of ffebruary<br />
1652 old stile or 1653 new stile went from dunkerke to Amsterdam<br />
to receyve the sayd vessell, and being come to Amsterdam where the<br />
sayd shipp so lay under Arrest, he this deponent in the name and for<br />
and on the behalfe of the sayd Meurin did there really and truly<br />
pay unto the sayd Reyner Johnson in Ryx dollars and ducatones<br />
the full summe of five thousand four hundred and fifty livers<br />
or Guilders for the sayd shipp being the summe contracted for<br />
asng the summe contracted for<br />
