Transcription Commission or letters of Reprizall againstCommission or letters of Reprizall against ffrench and dutch,<br /> And saith the said Love and<br /> Companie being destitute of a Vessell fitt for the execution and imployment of the<br /> said Commission this deponent furnished them with a Vessell to him belonging<br /> called the ''Prosperous'', which by Vertue of the said Commission was sett out to sea<br /> under the Conduct of one Captaine White, who happening to be slayne in an<br /> engagement against the ffrench, the said Philip Marshall then Lieutenant of<br /> and to the said White, was, by order of this deponent by a letter sent to him to Bilboa<br /> in the name of himselfe and of the rest of the Owners and Armours of the said<br /> shipp, constituted Captaine and Commannder thereof, and ordered to Conduct her<br /> for the Port of London, in obedience to which order the said Philip Marshall with the<br /> said Vessell coming into Torbay, and being destitute of provisions, went ashoare<br /> with his boate and nine of his Crew, carrying along with him the said Commission<br /> or letter of Reprizall expressely for the satisfaction of the Magistracie or<br /> Officers of this Commonwealth there residing. And afterwards the said Captaine<br /> and those other nyne of his Companie coming from ashoare with their boate,<br /> and designed to goe aboard their said shipp, they were all of them cast away<br /> and perished in the sea, and the said Commission or letters of Reprizall were<br /> also lost with the said Captaine, The premisses hee knoweth, for that hee this<br /> deponent upon the first newes of the said desaaster sent downe his brother and<br /> 7. men expressely to informe himself thereof, and to bring about the said Vessell<br /> for London where shee is at present, at this deponent by the credible and constant<br /> affirmation of such of the said shipps Companie as remained aboard her when<br /> the said disaster happened, and for that the said Commission can by no meanes be<br /> found in or aboard the said shipp or elswhere, is fully Convinced and assured<br /> the same together with the said Captaine Marshall was lost and sunke in the<br /> sea, so that the Armourers and Imployers interresed therein are by that meanes<br /> totally deprived thereof.
