To the 10th hee saith that in case the open lighter arlate had bin fully laden the monday<br />
aforesayd as shee might have bin (as hee beleeveth) if the company of the sayd shipp<br />
''Smirna ffactor'' had pleased heee this deponent intended to have gone<br />
away with her and her ladeing that some might soe soone as the tyde served<br />
as well as the sayd Cloase lyter did with her ladeing, and doubtedly not but hee<br />
should have safely arrived therewith at Galley Key arlate and that without any<br />
damage hapening to any goods laded into her dureing the tyme they had continued<br />
in the sayd lyter. And further hee cannot depose
To the 11th hee saith that hee beleeveth that in case the plugg of the Open lyter<br />
aforesayd had bin struck out or scooped out the lyter would have suncke<br />
and bin Covered and buried in water in a short tyme which hee saith hee<br />
found at his coming againe to her the next morning shee had not bin,<br />
and saith hee well knoweth the plugg of the sayd lyter was not at any<br />
tyme loosened or scooped out by this deponent nor the sayd Purse, nor<br />
as hee verily beleeveth and is perswaded in his conscience by any other<br />
imployed by the arlate Mills and Boulton And further to this articlehee cannot depose/
To the last hee saith his foregoeing deposition is true/
To the Crosse Interrogatories/ [CENTRE HEADING]
To the first Interrogatorie hee saith hee well knoweth the Interrogated Mills and<br />
Boulton and hath soe knowne them both for these 12 yeares last<br />
past and saith the sayd Boulton is a servant to the sayd Mills and doth<br />
often lett out and agree for lighters to unlade shipps and the sayd Mills<br />
doth if hee like of the bargaine by him the sayd Boulton made<br />
allowe of what hee doth in that kinde and imployeth his lighters according<br />
to the sayd Boultons agreement if hee like thereof, otherwise not as<br />
hee knoweth And further hee cannot answere/.
To the 2 Interrogatorie hee knoweth not nor hath heard with[?XX] any such<br />
agreement as is Interrogated were made betwixt the Interrogated Boulton and<br />
hudson and hee saith that the first lighter which the sayd Boulton sent to take<br />
goods out of the ''Smirna ffactor'' was a Cloase lighter which belonged to<br />
the sayd Mills which went and laded from the sayd Shipp fine goods and<br />
brought them to Galley Key aforesayd and afterwards the sayd Boulton<br />
sent open lighters which brought each of them a ladeing of Course goods as<br />
Cotton woolls and other course goods to Galley Key and there discharged them<br />
before there came occasion for to use the cloase lighter aforesayd belonging to<br />
the sayd Ambrose Pomery (for the makeing roome to lade which the open<br />
lighter wherein the damage controverted happened was vered from her<br />
place) And saith that when fine goods rise there is not a necessitie that goods rise there is not a necessitie that +
