To the 6th hee saith hee cannot depose not knowing what transactions have<br />
passed betwixt the arlate Mathew and George Abbott nor who shipped the<br />
67 hogsheads of Tobaccoe arlate./
To the 7th hee saith hee knoweth both George and Mathew Abbott and saith they are<br />
accompted subiects of this Commonwealth and as hee beleeveth subiect to the authority<br />
of this Court./

on the behalfe of the sayd Percivall Gilbert<br />
the 12th of March 1654/

aged 26 yeares or thereabouts a witnes sworne and examined<br />
saith and deposeth as followeth videlicet./
To the sayd allegation made the 12th of March 1654 in the acts of Court<br />
hee saith that in the moneth of September last past there laye in the harbour<br />
of Portsmouth the allegate shipp called the ''Brandares'' laden with salt and saith<br />
that the allegate Percivall Gilbert did contracte with the subcommissioners of<br />
prize goods at Portsmouth as hee told this deponent when hee came home for the second third of the sayd shipp ladeing of salt<br />
which was fifty weigh and paid unto one Mr Samuell Williams (who is either one<br />
of the sayd subcommissioners or a Clarke unto them) a hundred pounds in parte<br />
payment for the sayd second third of salt (as the sayd Mr Williams did acknowledge<br />
to this deponent) and saith that hee this deponent soone after the sale of the<br />
salt aforesayd to the sayd Percivall Gilbert by the sayd subcommissioners,<br />
was sent by the sayd Percivall Gilbert to the sayd Mr Williams<br />
with a letter to demande of him the sayd Williams the sayd 50 weigh of salt<br />
and there was a boate sent by the order of the sayd Percivall Gilbert to lade the<br />
same in which this deponent could have laded the same in 3 or 4 dayes tyme if hee might have bin permitted soe to doe And this deponent having delivered the sayd letter to the sayd Williams,<br />
in the behalfe of the sayd Percivall Gilbert demanded of the sayd Williams the syd<br />
fifty weigh of salt, who told this deponent that the first third part of the sayd<br />
shipps lading of salt was sold to (the allegate) Mr Blake and that hee had not<br />
taken the same out of the sayd shipp and therefore hee the sayd Percivall<br />
Gilbert could not have his second third part of the sayd salt before the sayd<br />
Blake had taken away his first third and soe refused to deliver the sayd<br />
second third to this deponent whereupon this deponentw as forced to goe<br />
away and send the sayd boate away without the sayd second third of the<br />
sayd salt to the sayd Percivall Gilberts great losse and damage who had<br />
sold 28 weigh which makes 140 quarters of the sayd salt to one John Knight of Cowes in the Ile of<br />
Wightt of Cowes in the Ile of<br />
