deposeth that hee this deponet and the ssa … deposeth that hee this deponet and the ssayd Thomas Wood arrived at Boston<br />
in New England upon or about the twentith day of June 1654 (at which<br />
tyme the shipp ''Saint John Baptist'' and goods in her were not arrived and come thither) and<br />
this deponent and the sayd Thomas Wood and Mt James Garrett Commander of the ''hopewell''<br />
went all of them togeather the same day of their arrivall to the arlate Segewick and<br />
Levert and this deponent delivered unto them a letter sent to them from the sayd<br />
Arnold and Elias Beake and Company (which letter this deponent hath alsoe read and<br />
passed) wherein the sayd Owners did acquaint the sayd Sedgewick and Levert<br />
with their propriety in the sayd shipp ''Saint John Baptist'' and goods seized therein<br />
and that they had sent him this deponent to signifie soe much to them and for<br />
the better manifestation of the truth thereof had also by him sent coppyes of<br />
the proofes by them made in the Admiralty Court of England touching their<br />
propriety therein and alsoe the originalls of their owne affidavits made in Chancery to the<br />
same effect and had ordered this deponent to demande the same shipp and goods and this deponent<br />
then alsoe shewed and delivered the sayd Sedgewick and Levert the sayd examinations and<br />
affidavitts attested as aforesayd who read and perused the same, and this deponent<br />
did alsoe afterwards leave coppyes of the sayd examinations and affidavitts<br />
with the sayd Sedgewick and Leveret, And this deponent desyred the sayd Sedgwick<br />
and Leveret that in the respecte the Interest of the sayd Owners did soe plainely<br />
appeare, they the sayd Sedgewick and Leveret would deliver or cause to be<br />
delivered to him this deponent for the use of the sayd Owners the sayd shipp<br />
the ''Saint John Baptist'' and her ladeing (shee being then but approaching neere<br />
unto Boston ad the goods undisposed of) that soe hee this deponent might dispose<br />
of them to the best benefit of the sayd owners and prevent as much damage<br />
thereby as might be, but the sayd Sedgewick and Leveret answered<br />
that they would not deliver the same, And hee alsoe saith that upon the<br />
two and twentith of June 1654 and not before the sayd shipp ''Saint John<br />
Baptist'' with her ladeing was brought into the port of Boston in New<br />
England by those to whose trust shee was Committed by the sayd<br />
Sedgewick and Leveret, And this deponent and the sayd Thomas Wood and Mr garret did on<br />
the three and twentith of the sayd June goe againe to the sayd Sedgewick and Leveret<br />
and this deponent againe before the sayd witnesses did then demand of<br />
the sayd Sedgewick and Leveret the sayd shipp ''Saint John Baptist'' and her ladeing<br />
(it being then come to Boston) for the use of the sayd Owners but the sayd<br />
Sedgewick and Leveret then refused to deliver the same to this deponent and<br />
sayd they would consider of the examinations brought from the Court of Admiralty<br />
and the affidavits made in Chancery and returne an answere to this<br />
deponent the next day Whereupon this deponent went the next day being the<br />
twenty fowerth of June 1654 accompanyed with the sayd Thomas Wood<br />
and James Garrett and againe demanded of the sayd Sedgewick and Leveret the<br />
sayd shipp ''Saint John Baptist'' and ladeing for the use of her sayd Owners but<br />
