hee had bin in great danger to have had the same cast away<br />
by the ''Exeter Merchants'' falling fowle as aforesayd. And further<br />
hee cannot depose/
To the 5th hee saith hee knoweth that the repayre of the damage which<br />
hee sawe done to the ''Exeter Marchants'' quarter and gallerie, and her<br />
new mooreing could not chuse but Cost her Owners a considerablr<br />
summe of money by what hee knoweth not And further hee cannot depose
To the 6th hee saith hee referreth him selfe to the Registry of this Court<br />
and further cannot depose/
To the 7th hee saith<br />
that the damage by him predeposed<br />
of happened to the ''Exeter Marchant'' by reason of the arlate Captaine<br />
Smiths cuttinh her hawser as aforesayd and turning her on drift, and hee<br />
verily beleeveth if the sayd Smith had not soe cut her hawser shee had<br />
not bin damaged, nor shee and the ''Pilgrim'' and the sayd shipp lying by<br />
the ''Pilgrims'' side forced on ground And further hee cannot depose./
To the last hee saith his foregoeing deposition is true./
To the Interrogatories/
To the first hee answereth negatively./
To the 2 Interrogatorie hee saith hee was present at the tyme Interrogated and saith the same<br />
was in the afternoone of the day and saith there were present beside the company<br />
of the ''Exeter Merchant'' on James Merrit and one William Gage watermen<br />
who were on board the ''Exeter Merchant'' and imployed to bring her up, and hee this<br />
deponent was in his wherrie as aforesayd and further hee cannot answere saving<br />
his foregoeing deposition./
To the third Interrogatorie hee saith hee is about 39 yeares of age and hath bin a waterman<br />
be;onging to the River of Thames these 20 yeares last past and well knoweth<br />
the custome by him predeposed of videlicet that shipps coming into the River of Thames<br />
laden may by the Custome of the River fasten for one tyde to any shipp<br />
they finde there rideing And further to this Interrogatorie hee cannot answere./
To the 4th hee saith hee knoweth that the shipp ''ffrancis and Mary'' at the tyme<br />
Interrogate laye at the lower chayne at Lymehouse outward bound, and hee<br />
sawe her take in certaine provisions in casks, but saith shee was not at the tyme Inteerrogate<br />
in the acte of receiving in any goods, And further to this Interrogatorie hee cannot<br />
answere./
To the 5th hee saith it is the custome that a shipp coming<br />
in laden into the River of Thames may fasten for one tyde to any shipp<br />
there lying though outward bound and receiving or about to receuve<br />
goods on board and may though the Master and Company of the outward<br />
bound shipp be unwilling thereto come on board the outward bound shipp<br />
andrd the outward bound shipp<br />
