And fasten their roapes thereto and ride … And fasten their roapes thereto and ride thereby for one tyde<br />
provided they vere and make way for goods to come aboard the<br />
outward bound shipp if occasion serves, and saith if the shipp soe<br />
making fast doe not vere and make way for the outward bound shipp to<br />
take in such ladeing as cometh while the other shipp is soe made fast to her<br />
by the Custome aforesayd the outward bound shipp may recover such damage<br />
of the shipp soe fastening to her as shee is put to for the tyme the goods<br />
to be taken in are soe hindered And this hath hee knowne to bee the Custome<br />
for the most part of the tyme hee this deponent was a waterman videlicit for these 20 yeares last and hath<br />
heard it hath bin the Custome of the sayd River in that case tyme out of<br />
memory of men now living, and saith hee hath found the same often<br />
done and remembereth about a yeare since hee sawe some of the Company of the shipp the<br />
''Planter'' (being then come laden from Virginia) goe aboard and fasten upon the shipp the<br />
''Loyalty'' shee then lying at the middle chayne at Lymehouse (Captain Limbre then Commander of her) without the leave and<br />
good likeing of the sayd Captaine and his Company this hee knoweth for<br />
that hee sawe the same done, and sawe and observed the botswaine of the ''Loyalty'' to be<br />
much offended thereat<br />
And saith hee hath knowne the like done by divers<br />
other shipps but remembereth not at present the names of the shipps or<br />
their Commanders or the place where or tyme when, but well knoweth<br />
it is a usuall thing for shipps soe to doe And further to this Interrogatorie hee<br />
cannot answere.
To the 6th Interrogatorie hee saith saving his deposition to the second third and 4th articles of the allegation to which hee referreth hee cannot answere./
To the 7th hee saith the hawser of the ''Exeter Merchant'' which was fastened<br />
to the Cable of the ''ffrancis'' ''and'' ''Mary'' was made fast thereto after the<br />
Interrogate Thomas Smith had forbidd the sayd Woodfins company to fasten<br />
any hawser to his shipp the ''ffrancis'' ''and'' ''Mary'' And further hee cannot<br />
answere./
To the 8th hee saith that at the tyme Interrogate the ''Exeter Merchants'' company could<br />
not (as hee beleeveth) if they would have brought her safely to an Anchor<br />
in any other parts of the Thames beside the lower chayne at Lymehous<br />
for that shee came thither iust upon the topp of a tyde very little<br />
before ebbing water soe that shee had noe better way at present to prevent danger<br />
to her selfe and ladeing than to fasten to the ''ffrancis and Mary'', as<br />
this deponent verily beleeveth, And saith other shipps did then lye safe<br />
in other places of the River of Thames besides the lower chayne at<br />
Lymehouse but hee beleeveth they came to their places where they soe lay before<br />
the tyde or ffludd was soe much spent as it was when the ''Exeter Merchant'' came to the<br />
Lower chayne at Lymehouse And further to this Interrogatorie hee cannot answere/
To the 9th hee saith the ''Exeter Merchant'' came on the outside of the<br />
''ffrancis and Mary'' And further saving his foregoing deposition hee cannot<br />
