thereto answered in presence of this deponent and the sayd witnesses that hee<br />

to give her a lyst inwards and with all sayd hee cared not though hee had<br />
sunke the shipp ''William'' and sayd hee would not give him two pence<br />
damage though hee had sunke her, and bid the sayd huntington<br />
mend him selfe as well as hee could or words to that effect And further<br />
saving his subsequent deposition hee cnnot depose/
To the 7th 9th and 10th articles of the sayd libell hee saith that the damage prdeposed<br />
of happened to the ''William'' aforesayd by the willfullnes of the Master<br />
and Company of the ''Waterhound'' and by their wilfull lusting and leaneing<br />
their sayd shipp upon the ''William'' in manner aforesayd and<br />
saith the ''Waterhound'' might have layne in safety by the ''William''<br />
without lusting inwards upon her and saith hee is well assured if the<br />
Master and Company of the ''Waterhound'' had not willfully lusted their sayd<br />
shipp inwards and leaned her soe upon the ''William'' the samage in<br />
question had not bin done And hee alsoe saith of his knowledge<br />
the sayd shipp ''William'' before shee receaved the damage predeposed by<br />
the meanies and in the manner predeposed was a tight stanch and strong<br />
shipp and saith after the sayd damage soe done her Master and company<br />
did endeavour to have sayled her downe the River of Thames toward<br />
Sheilds arlate whether shee was bound to lade salte ad carry the same<br />
to Gainsborowe but by reason of the sayd damage shee was soe leakie<br />
and bruised that shee tooke in soe much wayer before shee came to<br />
Greenwich that her Master and company were forced there to put<br />
her a shoare to repayre her and amend her leakes before they durst<br />
adventure to goe to sea in her which damage done her in manner<br />
predeposed could not (as hee beleeveth) cost lesse then tenn pounds<br />
sterling and soe much hee hear the Carpenter who repayred her<br />
saye (upon view of her) it would cost to repayre the sayd damages And hee further saith<br />
the sayd shipp the ''William'' was as aforesayd bound to Shields and Gains=<br />
borowe and by reason of the damage aforesayd hath spent and is like to<br />
spend more tyme in repayre of the sayd damage then would have<br />
sufficed to have accomplished the sayd voyage And hee alsoe saith<br />
hee beleeveth the arlate huntington and Company will susteyne samage<br />
by his sayd losse of tyme and for mens wages and<br />
victualls tenn pounds sterling at the least And further to these articles<br />
hee cannot depose./
To the 12th hee saith hee cannot depose./
To the 13th and 14th hee saith ee referreth himselfe to the Registry of this<br />
Court and to his foregoeing deposition and to the lawe and further hee cannot<br />
depose
To the 15th hee saith hee beleeveth the arlate Constant is a subiect of this Commonwealth and subiect to the Jurisdiction arlate and further<br />
hee cannot depose
To the last hee saith his foregoeing deposition is true/
