hath divers tymes within these fifty years … hath divers tymes within these fifty years last past seene the ffishermen<br />
tennents of the sayd hundreds and mannor of ffeversham in the sayd<br />
Court hole for the sayd mannor to collect of oath other money towards the<br />
payment of the sayd yearly rent and pay the same to stewards of the sayd Court but tooke not soo stricte notice as to<br />
observe what the whole summe collectively came to, but hath heard the sayd yearly<br />
reat is 20 m X m li And hee further saith hee well knoweth William Luson and<br />
the rest of the parties allegate and saith they are commonly of the hundred<br />
and mannor of ffeversham allegate and hee soo have bin for divers<br />
years last past some of them for sixe yeares last and some for more and for such<br />
are commonly reputed And this deponent hath often seene them appeare in the<br />
sayd Court hold for the mannor and hundreds of ffeversham as tennants thereof<br />
and serve in the same as iuries thereof, and seene them fish for oysters<br />
and other fish in the grounds in question as tennants of the sayd mannor and<br />
hundred And further to this allegation hee cannot depose:/

aforesayd, dated the 10th of October 1655/
To the first and second articles of the sayd allegation hee sayeth and<br />
deposeth that hee hath divers tymes within these twenty years last past<br />
heard the Tennants of the hundred and manor of ffeversham reckon with<br />
oath other touching moneys expended by them in buying oysters yearely<br />
to stowe the grounds arlate and thereby knoweth that their reckonings for<br />
soe doing have some and yeares amounted to twenty pounds and some yeares<br />
thirty pounds a yeare and some yeares tenn pounds a year for stowing the sayd<br />
grounds, and saith according to common fame and reporte in ffeversham and places adiacent the tennants of the<br />
sayd mannor and hundred andthey only have tyme out of mynde used to stoare the sayd grounds<br />
with oysters soo oft as occasion required And hee alsoe saith that hee this deponent<br />
hath often within this twenty or thirty yeares last having occasion to passe by<br />
that way in boates observed that the ffishermen Tennants of the mannor and hundreds<br />
of ffeversham or others for them and in their behalfe have usually watched the sayd<br />
grounds in question yearely from, about Lammas till after michaelemas<br />
to prevent ffishermen of other places from coming<br />
to fish for oysters in the sayd grounds, but what it cost them weekly for soe<br />
doeing hee cannot of his knowledge depose, but saith hee hath hee heard some of the<br />
sayd tennants of ffeversham mannor and Lord shipp saie that it cost them weekely<br />
amongst them all for the tyme they soe watched somtymes thirty shillings a X GUTTER<br />
and sometymes more, And hee further saith hee never heard that any but the<br />
tennants of the sayd mannor and hundreds of ffeversham ever were at any charge<br />
to stowe the sayd grounds with oysters, or watch therein, or ever had any right<br />
to fish for oysters of other fish in the grounds in question and further sayd<br />
his foregoeing deposition made to the allegation made in the acts of Court within<br />
cause to which hee referreth hee cannot depose/
To the last hee saith his forgoing deposition is true./

To the first Interrogatorie hee saith hee is not compelled by any order of this<br />
Court but cameth to testifie in this cause at the request of the producents<br />
who beare his charges, and saith hee is noe fisherman of nor tennant to the grounds in question nor useth to fish in the places<br />
interrogate, and favoureth both parties litigant alike and desyreth right<br />
