Transcription other persons whatsoever and hee this depoother persons whatsoever and hee this deponent having bin a ffisherman<br /> at milton for about twelve yeares of the tyme hee lived there,<br /> never heard, that any ffishermen of milton or any<br /> other place allegate, or any save the ffishermen tennants of the mannor<br /> and hundred of ffeversham ever had any right to fish in the sayd<br /> grounds either for oysters or other fish or were quietly permitted soe to fish there but the sayd tennants of the<br /> mannor of ffeversham and hundred thereof did all the sayd tyme and alsoe<br /> ever since this deponent came to live in the hundred of ffeversham<br /> at Owre which hath bin for about two and twenty yeares next after his<br /> soe liveing at milton) quietly enioys the fishing of the sayd grounds<br /> both for oysters and other fish to themselves and convert the fish thereof<br /> to their owne use without any interruption, exluding all other<br /> fishermen whatsoever saving hee saith that within these twenty two<br /> yeares last past some ffishermen of Stroude and Milton have<br /> secretly in the night tyme as it were by stealth fished for oysters<br /> and other fish on the grounds in question and were taken soe doeing<br /> and these ffishermen of strowde of this deponents knowledge were<br /> imprisoned at ffeversham for the same and did<br /> in the presence of this deponent and others acknowledge themselves<br /> trespassers against the Lord of the mannor of ffeversham and his<br /> tennants for soe doeing, and entered into bond<br /> that they nor their servants would not fish there any more or to<br /> that effect whereupon they were discharged And hee saith that<br /> the Milton fishermen soe taken whose name hee remembreth not at present did without being imprisoned acknowledge<br /> before this deponent and others that hee had trespassed against the Lords<br /> of the mannor of ffeversham and his tennants of the sayd mannor<br /> and the hundred thereof in soe fishing upon the sayd grounds, and by the<br /> meanes of this deponent (who interceaded for him to the water<br /> bayly of the sayd mannor and hundred) hee ?compounded for such his<br /> trespasse for a smale summe of money which as hee now remembreth<br /> was twelve shillings and soe was discharged, And hee further saith<br /> that ever since hee this deponent came to live at Owre aforesayd hee<br /> knoweth that the tennants of the mannor and hundred of ffeversham<br /> for such their priviledge to enioye the fishing of the sayd grounds<br /> solely to themselves exclusive from all other ffishermen, doe<br /> annually pay to the Lords of the sayd mannor of ffeversham or his<br /> steward twenty three shillings foure pence and hee this deponent being a tennant hath yearely paid this part thereof during the sayd tyme And saith the allegate<br /> Luson and other the producents in this cause are tennants of the mannor and<br /> hundred of ffeversham and soe have bin and are commonly and ?compted for divers yeares<br /> last past of this deponents knowledge And further to this allegation hee cannot depose/ther to this allegation hee cannot depose/  +
