Transcription To the second article of the sayd allegatiTo the second article of the sayd allegation hee saith that upon or about<br /> the first of May 1655 the sayd Vessell returned from Zant and Cadiz<br /> arlate laden with Currance and Verina Tobaccoe and being come into<br /> the River of Thames neere Lymehouse the sayd Woodfin and Company<br /> (the tyde of ffloud being spent that they could not carrie their sayd vessell any higher<br /> up the River) endeavoured to bring her to the lower chayne at Lymehouse there till<br /> lowe water, the sayd Woodfin caused a hawser to be fastned to<br /> the Cable or the boltsprit (but which of them hee remembreth not) of the ''ffrancis and Mary'' arlate (as shipp who lay fastned to the<br /> sayd chayne) the premisses hee deposeth being Quarter Master of, and aboard the ''Exeter Merchant'' when they soe happened And hee saith hee hath observed during all the tyme<br /> that hee hath bin a seaman, (which hath bin for these twenty sixe or twenty<br /> eight yeares last past) it hath bin a usuall Custome that any shipps<br /> comming into the River of Thames laden may and doe ususally for better preservation<br /> of them and their ladeing fasten to and upon an other shipp there either moored,<br /> or rideing by the chayne, for the space of one tyde, And further saving<br /> his subsequent deposition hee cannot depose/ To the third article of the sayd allegation hee saith that the sayd Woodfin<br /> having caused a hawser to be fastned either to the boltspritt or<br /> Cable of the ''ffrancis and Mary'' did cause his shipps company to heave the shipp<br /> ''Exeter Merchant'' up to the Midshipp of the ''ffrancis and Mary''<br /> entending to fasten an other hawser to some other part of the sayd<br /> shipp ''ffrancis and Mary'', but the arlate Smith the Master of her would<br /> not suffer the sayd Woodfin and Company soe to doe, but in a violent<br /> and willfull manner contrary to the usuall custome in such cases frequent<br /> and observed upon the River of Thames did cause the sayd hauser which was<br /> fastned as aforesayd either to the Cable or boltspritt of his shipp the ''ffrancis''<br /> ''and Mary'' after it had bin soe fastned a quarter of an hower and better to be cutt by one of his shipps company, and thereby turned<br /> the ''Exeter Merchant'' with all her ladeing on drifte to the hazard of the losse<br /> of her and it, and danger of other shipps and their goods who laye neere thereunto<br /> The premisses hee deposeth for the reasons aforesayd being an eye witnes And further saving his subsequent deposition hee cannot depose/ To the 4th article of the sayd allegation hee saith that the ''Exeter Merchant''<br /> her hawser being soe wilfully cutt by meanes of the sayd Smith and his<br /> Company and shee turned a drifte, and the tyde of ebb then running stronge,<br /> the sayd Woodfin and Company presently vered their Cable and let fall an Anchor<br /> to stay their shipp the ''Exeter Merchant'', and used their utmost diligence to prevent<br /> her from receiving any damage and from damnifying any other shipps neere<br /> her, which notwithstanding the force of the tyde was such that it carried her<br /> fowle of the Boltspritt of the ''Pilgrim'' arlate, who ridd a sterne of her, and<br /> by that meanes the Quarter of the ''Exeter Marchant'' was broken downe<br /> by the Boltspritt of the ''Pilgrim'', and the aunchient staffe of the ''Exeter Marchant''<br /> broken and lost, and shee, and the ''Pilgrim'' and a Collier that lay on board the ''Pilgrim''<br /> was by force of the tyde runne on ground the premisses hee deposeth for the reasons aforesayd And further hee cannot depose/s aforesayd And further hee cannot depose/  +
