Transcription To the fourteenth article hee saith and deTo the fourteenth article hee saith and deposeth that neither hee nor<br /> his said brother neither in the ''Angell'', ''Yellow Sun'' or ''Saint Nicholas'' foresaid<br /> tooke or seized any English shipp or shipps, or English or dutch men<br /> nor sent any such prisoners to Santa domingo, although at the time<br /> when they were as aforesaid forced to Tertoudas, there were warrs<br /> between England and holland, whereby they might lawfully have<br /> taken English, but did not. To the fifteenth hee saith that there were only in the ''Saint Nicholas''<br /> her owne twelve guns in her when shee went to Santa domingo and about a dozen muskets, and<br /> powder and ball convenient for them for her service, and noe<br /> other armes or amunition but what was for her owne necessary<br /> use, nor any souldiers or other passengers but only the said<br /> President and foure servants namely three men and a boy, a Holland<br /> shipp that was freighted by the Spaniards which men from<br /> Cadiz about a moneth before this deponents said departure then<br /> with the ''Nicholas'', which shipp the ''Mary'' carried good store<br /> of amunition, and ordnance and three or foure hundred souldiers in<br /> her from Cadiz for Santa domingo, and arived there with the same,<br /> this deponent seeing the lading and imbarking thereof at Cadiz,<br /> and upon his arivall at Santa domingo seeing the said Ordnance,<br /> and amunition taking out of her, And at Santa domingo this<br /> deponent and his said brother tooke and put into the ''Nicholas'' twelve<br /> other guns, which were belonging to their said two former<br /> shipps, which they did with the license of the Governour. To the sixteenth hee saith that there were noe letters or<br /> papers or writings whatsoever that were in the custody of this<br /> deponent or of his said brother or any of their company, that were<br /> torne, burnt, throwne over board or otherwise made away, but<br /> were all delivered by this deponent over to Captaine Adams<br /> his lieutenant who carried them aboard the ''Maidstone frigot''<br /> saving such of the shipps papers and dispatches as were in his<br /> said brothers owne custodie, which his said brother himself<br /> carried aboard the frigot to Captaine Adams upon the said<br /> seizure, nor doth hee know of any papers whatsoever that were made away. To the seaventeenth hee saith that the Castle of Santa domingo<br /> is about an English mile distant from the place where the ''Saint Nicholas''<br /> came on and moored there, and the towne being betweene those<br /> places, one in the castle cannot see a shipp lying where the ''Saint Nicholas''<br /> was, but may see them as they come in, for that they come neere<br /> the Castle, and saith that about a fortnight after the said shipps arived<br /> this deponent went to the Castle and saw the arlate Mr Aylet<br /> prisoner therein; and afterwards saw him in the towne. And<br /> otherwise hee cannot depose, saving that hee hath heard that some<br /> English have said that if they could get that shipp and lading to be<br /> condemned, they should have a good reward, but did not heare it<br /> of the parties themselves.
