To the 12th hee saith the said man of warr the time aforesaid had six<br />
peeces of ordnance and above fiftie men as hee estimated their number,<br />
and was well provided of ammunition and all other warlike necessaries<br />
as hee understood, and had a square or broad sterne, whereas the <br />
''ffalcon'' is but a small vessell and had noe guns greate or small or<br />
other armes or defense, and her company consisted but of five<br />
persons, namely the master and foure other men, and were noe wayes<br />
able to give the man of warr any resistance, or to hinder them from<br />
doing what they pleased.

the reasons afore yeelded hee knoweth that the said man of<br />
wars company tooke away all such goods as are wanting and gonne<br />
and that neither the ''ffalcons'' master nor any of her company tooke any.

''ffalcon'' aged seaventeene yeares or thereabouts sworne<br />
and examined.
To the first article of the said allegation hee saith and<br />
deposeth that about seaven weekes since (the time otherwise<br />
hee doth not now remember) the shipp arlate the ''ffalcon'' tooke<br />
in her lading of linen cloth pipestaves and other goods at<br />
Hamborowe bound therewith for this port of London,<br />
which hee knoweth being one of her company and helping to<br />
lade the same. And otherwise hee cannot depose.
