Transcription as this Deponent verily beleeveth and wereas this Deponent verily beleeveth and were brought to this port of London in [GUTTER] and saith that the said wheeler<br /> came aboard the said ship with the said Tobaccoe at<br /> such times as the same were brought onboard her<br /> and at other times and hee did intend to have come hether in [?GUTTER]<br /> with his siad Tobaccoe and this<br /> deponent being then Cooper of her had often times<br /> discourse with him and the said Wheeler coming onboard<br /> the said ship [?] after all his said Tobaccoe was<br /> brought aboard her this deponent asked the said Mr.<br /> Wheeler who should have his Tobaccoe if hee dyed<br /> to which the said Mr. Wheeler made answer in these words<br /> or the very same in effect, who dost thou thinke should<br /> have them but my child ffrank for all my care is for<br /> him, he meaning the producent ffrancis Wheeler the<br /> younger, And saith that hee the said ffrancis wheeler<br /> the Yonger did here at London before the ''Honor'' [?GUTTER]<br /> the said voyage to Virginia agree for the freeight<br /> of the foresaid Tobaccoe, and if the same were not<br /> laden onboard the said ship hee the said ffrancis<br /> Wheeler the yonger was to have Paid the Dead<br /> freeight this deponent having severall times seene and heard the<br /> Contract made for the same read And further cannot depose to the 3rd and 4th article hee saith that soone after the said<br /> ffrancis Wheeler had soe laded the said Tobaccoe on<br /> board the said ship Honor and before the Honor<br /> departed from Virginia with the said Tobaccoe hee [?departed GUTTER]<br /> this life, and the said ffrancis Wheeler deceased<br /> did leave one elleanor his widowe, who was mother<br /> in Lawe to the said ffrancis Wheelere the Yonger (party<br /> in this suite) and saith that hee hath bin credibly<br /> Informed that the said ffrancis Wheeler deceased did not<br /> receive and bills of Lading for the said Tobaccoe [GUTTER]<br /> that one Nicholas Trott did for the said Elinor [?GUTTER]<br /> bills of Lading for the same after the death of the said<br /> ffrancis Wheeler the Elder. And saith that this deponent hath<br /> oftentimes heard that the said ffrancis Wheeler deceased<br /> did before hee went to Virginia make his will and<br /> make his said son ffrancis the party in this suit hix Executor<br /> and to the rest hee referreth himselfe to the Registry<br /> of the Court for probate of wille and granting did [GUTTER?]<br /> And further cannot depose./?]<br /> And further cannot depose./  +
